Following Race 4 an Information was filed pursuant to rule 871 (1) (d). The Informant, Mr J Oatham, alleged that Miss McMullen, rider of BEAN CASUAL, shifted in when not clear causing crowding to JACOWILS (M Hills) and DASHING DONNA (J. McDonald). DASHING DONNA, in turn, shifted in causing a severe check to CENT PER CENT (A Peard) and VONUSTI (N Harris). This occurred at the 1100 metre mark.

Following Race 4 an Information was filed pursuant to rule 871 (1) (d). The Informant, Mr J Oatham, alleged that Miss McMullen, rider of BEAN CASUAL, shifted in when not clear causing crowding to JACOWILS (M Hills) and DASHING DONNA (J. McDonald). DASHING DONNA, in turn, shifted in causing a severe check to CENT PER CENT (A Peard) and VONUSTI (N Harris). This occurred at the 1100 metre mark.
--Miss McMullen was represented by her employer, Mr S McKee and pleaded guilty to the charge.
--Mr A Coles demonstrated the video films which showed that soon after the start Miss McMullen, who drew the outside stall, angled her mount in towards the running rail. It was evident on the film that she was not the required distance clear of JACOWILS when she moved in. This inward movement caused quite severe crowding to 4 runners on her inside.
--Miss McMullen had nothing to say and Mr McKee said Miss McMullen had corrected her mount but it was too late.
--PENALTY SUBMISSIONS
--Mr Oatham said Miss McMullen had ridden 112 times for 3 charges in that time. He submitted that Miss McMullen was the cause of severe interference in this case and reminded the Committee the race was for $35,000 on a premier day. He stated a suspension of 6 – 8 days would be appropriate.
--Miss McMullen said she wished any suspension to start after today as she had no committed rides.
--PENALTY
--The Committee carefully considered all submissions and evidence before imposing an appropriate penalty. Mitigating factors are Miss McMullen’s guilty plea and her relative inexperience. These have to be weighed against the aggravating factors of the checks received by 4 horses and the level of carelessness displayed by Miss McMullen. Because she angled her mount in without regard to those runners on her inside the Committee considers her carelessness to be in the mid to high range.
--Accordingly we impose a suspension from riding in races to start after racing today 26 September 09 and conclude after racing on 9 October 09 (7 days).
