As Ms Spratt admitted the breach we find the charge proved.
Penalty:
We grant Ms Spratt's request to seek a deferment to her suspension as per Rule 1106(2)
Accordingly, we impose a suspension on Ms Spratt which will commence after racing on 2 November and conclude after racing on 11 November 2013 (6 days).
Charge:
Following race 7, Harold Plumley1400, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Ms Spratt permitted her mount SPIN DOCTOR to shift inwards near the 1300 metres when not sufficiently clear causing crowding to ESTRATO, LUCKY COUNTRY, SHUKA, MILITARY MOVE and SUM UP.
Ms Spratt acknowledged that she understood the nature of the charge and the Rule.
Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Mr Oatham identified on the head on film that Ms Spratt permitted her mount to shift in on a sharp angle when only ½ to ¾ of a length clear. He said Ms Spratt had followed Ms Collett’s mount across however she misjudged the angle which placed several runners to her inside in restricted room and created crowding. He said Ms Spratt did attempt to correct her inward movement but it was a little too late as the incident had already occurred.
Ms Spratt in admitting the breach confirmed that she followed Ms Collett across and wasn't aware of the crowding to runners on her inside until it was too late to rectify the situation.
Submissions for Penalty:
Mr Williamson produced Ms Spratt's record which showed 5 previous breaches under this Rule in the last 12 months. He said these ranged from 4 to 6 day suspensions. He said the level of carelessness was in the low to mid range. He noted that several runners suffered varying degrees of interference. He added that Ms Spratt did take some corrective action but it was 2 to 3 strides too late.
Ms Spratt advised that she had upcoming commitments at Tauranga on 2nd of November and that any period of suspension could commence after that.
In response to a question from the Committee, Ms Spratt acknowledged that she had no intention to ride at Invercargill or Banks Peninsula in early November.
Ms Spratt asked the Committee to take into account the upcoming premier race days when imposing penalty.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating fact is Ms Spratt's admission of the breach. The aggravating factors are Ms Spratt's poor record under this Rule in the last 12 months. We assess the inward movement in the low range however the consequences of her actions were in the mid range with several runners being checked. We note that Ms Spratt erred in moving in on a sharp angle and did not allow sufficient room for horses on her inside. We accept that Ms Spratt did attempt to take corrective action but it was about 2 strides too late.
The Committee is aware of the premier meetings coming up. However, riders that fail to abide by the Rules have to accept appropriate penalties imposed as a consequence of their actions.
After taking into account all the above factors we consider an appropriate penalty is a 6 day suspension.
