As Ms Collett admitted the breach we find the charge proved.

Penalty:

We grant Ms Collett's request to seek a deferment to her suspension as per Rule 1106(2)

Accordingly, we impose a suspension on Ms Collett which will commence after racing on 30 October and conclude after racing on 9 November 2013(6 days).

Charge:

Following race 4, The Nonine Kiely Memorial, an Information was filed pursuant to Rule 638(1)(d) The Informant, Mr Williamson, alleged that Ms Collett permitted her mount SIMBAAH to shift outwards passing the 300 metres when not sufficiently clear of GARLAND which was checked.

Ms Collett acknowledged that she understood the nature of the charge and the Rule.

Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Facts:

Prior to commencement of the hearing Ms Collett advised the Committee that she did not require any assistance during the hearing. This hearing took place after the last race.

Mr Oatham identified on the head on film that at the 300 metres Ms Collett was held up for a run behind the leaders. He demonstrated on the films where Ms Collett permitted her mount SIMBAAH to shift out when only ½ to ¾ of a length clear of GARLAND. He said this resulted in a reasonably severe check to GARLAND when it had its rightful running line taken. He added in slight mitigation was the racing manners of SIMBAAH.

Ms Collett advised us that SIMBAAH was having its second start and was still very green. Ms Collett added that when she angled her mount out it caught her by surprise how much he shifted. She believed the horse over reacted to the movement.

Submissions for Penalty:

Mr Williamson produced Ms Collett's record which showed 5 previous breaches under this Rule in the last 12 months. He noted that 4 of Ms Collett's suspension occurred in Sydney and her New Zealand suspension occurred at Avondale on October 7. He said the level of carelessness was in the mid range and submitted a suspension in the range of 5 to 7 days.

Ms Collett advised that she had upcoming commitments at Counties on 30 October, and that any period of suspension could commence after that.

In response to a question from the Committee, Ms Collett acknowledged that she was not intending to ride at Invercargill or Banks Peninsula in early November.

Ms Collett asked the Committee to take into account the upcoming premier race days when imposing penalty.

When asked by the Committee, Ms Collett acknowledged that she had no firm commitments at Christchurch on the 9th of November.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating fact is Ms Collett's admission of the breach. The aggravating factors are Ms Collett's overall poor record with regards to careless riding in the last 12 months, we assess the level of carelessness as mid range and we note that Ms Collett was at best only ¾ of a length clear when shifting outwards. This resulted in a reasonably severe check to GARLAND.

The Committee is aware of the premier meetings coming up. However, riders that fail to abide by the Rules have to accept appropriate penalties imposed as a consequence of their actions.

After taking into account all the above factors we consider an appropriate penalty is a 6 day suspension.
