This charge arises from race 7 Sky City Eight Carat Classic (Group 2). An Information was filed pursuant to Rule 330(3)(c). The Informant, Mr Oatham, alleged that Mr Harris failed to make the contracted weight for TEARS OF JUPITER
Mr Harris said that he understood the Rule and confirmed he admitted the breach.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Oatham advised that Mr Harris failed to make the contracted weight of 56.5 kgs on TEARS OF JUPTIER due to being ¾ of a kg overweight. He added that he was replaced by Mr Dee.
Mr Harris had no explanation for this breach.

Mr Oatham said that Mr Harris has incurred 3 previous breaches of this Rule in the last 12 months. This breach is his 2nd within the reset period of 120 days and would normally be dealt with by way of a $200 Minor Infringement notice. However, given the breach occurred in a Group 2 race the Stewards submitted that a $300 to $400 fine would be appropriate.
Mr Harris said he accepted a monetary penalty would be imposed.

In determination of penalty the Committee took into account that this is Mr Harris’ 2nd breach within the reset period of 120 days, the betting public has an expectation that Mr Harris would fulfil his engagement. The clear aggravating factors were the breach occurred in a Group 2 race with stakes payable of $100,000 and the connections had to find a suitable replacement rider at short notice.
