As Mr Hashizume admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a deferment to Mr Hashizume’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Hashizume had his license to ride in races suspended for a period to commence after racing on 28 December 2019 and conclude after racing on 5 January 2020.
Facts:
Following the running of race 5, the Headquarters Viaduct – The Lonely Hearts Club 1200 metres, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Oatham, alleged that Mr Hashizume permitted his mount ONE KOTUKUSTREET to shift out near the 400 metres when insufficiently clear of STYLISH SUGGESTION which was checked.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Hashizume acknowledged that he understood the Rule and confirmed that he admitted the breach.
Mr Hashizume was assisted at the hearing by his employer, Licensed Trainer Mr G Cooksley.
Mr Coles demonstrated the incident using the available video footage. He said as the field approached the final straight ONE KOTUKUSTREET was racing 3 back on the rails. He identified that Mr Hashizume shifted out when only a bare length clear of STYLISH SUGGESTION, also inconvenienced was BREEZON. As a consequence Mr Dee, the rider of STYLISH SUGGESTION had to take a strong hold of his mount to avoid the heels of ONE KOTUKUSTREET.
Mr Hashizume said that he made a mistake when he angled his mount outwards on the turn.
Mr Cooksley had nothing to add.
Submissions for Penalty:
Mr Oatham said that Mr Hasizume had 1 previous breach under this Rule from 110 raceday rides to date. He described the level of carelessness as mid-range and a penalty in line with that would be appropriate.
Mr Hashizume said that he had engagements at Matamata on 28 December and any proposed suspension could start after that date.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
When reviewing the video footage we found that on the point of the turn Mr Hashizume angled his mount out in a sharp manner. In doing so he was only 1 length clear of STYLISH SUGGESTION which was checked to avoid heels. BREEZON was also inconvenienced as a result. We assessed the level of carelessness to be mid-range and adopted an 8-day starting point.
The mitigating factors were Mr Hashizume’s admission of the breach, his clear record since his only other breach of this Rule over 10 months ago in February 2019. For these combined factors Mr Hashizume was afforded a 1-day reduction in penalty
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
