Decision:
Due to the charge being admitted by Mr Cameron it was deemed to be proved by the Judicial Committee.
Penalty:
Mr Cameron’s Jockeys License was suspended from the close of racing on 1 January 2017 up to and including all racing on 12 January 2017 (6 days) and in addition a fine of $1,000 was imposed.

Facts:
Following the running of Race 9 (Zabeel Classic), Information No. A8653 was filed with the Judicial Committee. It was alleged by Mr Oatham that Mr Cameron the rider of VOLKSTOK’N’BARRELL allowed his mount to shift out when not clear of SAINT EMILION which was crowded and checked. It was alleged to have occurred over the final 50m of the event.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless.
Mr Cameron said that he understood the Rule and confirmed to the committee that he admitted the breach.
Mr Oatham had Mr Coles identify the runners concerned on all film replays and invited Mr Coles to place his interpretation on the alleged incident. He said that Mr Cameron had allowed his mount to shift out, crowd and then check SAINT EMILION. He said that when SAINT EMILION was checked he was clearly in 3rd position and that the check cost the horse 3rd placing.
Mr Cameron, for his part, said that his horse was tiring and started to drift out and that he got caught up in the moment and that he had straightened his horse but that it was too late. He added that he had misjudged it.

Mr Oatham said that Mr Cameron had a very good record, having had only one breach of the Rule during the previous 12 months and that he had admitted the breach at the first opportunity.
He said that the aggravating factors were that it was a Group 1 Race with a stake of $200,000 and that SAINT EMILION had been denied the opportunity of finishing in 3rd placing and that the difference in prize money, 3rd against 4th, was $10,000. Mr Oatham invited the Judicial Committee to consider imposing a fine on top of any suspension imposed as an added penalty. He placed the carelessness in the mid-range area.
Mr Cameron said that he did cost the owners (SAINT EMILION) a lot of money. He said that he would like any suspension to commence after racing on 1 January 2017 and if at all possible he would like to be back riding at the Wellington Cup Carnival. He said that although he does ride in the South Island, he had no intention of riding at either Reefton or Hokitika.

The committee noted that over the concluding stages of the race VOLKSTOK’N’BARRELL gradually commenced to shift out when being hard-ridden and did so to such an extent that it went into the rightful running line of SAINT EMILION and as VOLKSTOK’N’BARRELL continued its outward movement SAINT EMILION ran out of racing room and was forced to be sharply checked by its rider.
The aggravating factors were that it was a Group 1 Race with a stake of $200,000. In the opinion of the Judicial Committee the carelessness exhibited by Mr Cameron cost SAINT EMILION 3rd placing, with the difference in prize money, 3rd to 4th being $10,000. This matter will be reflected in the imposed penalty. The committee placed the carelessness in the mid-range with the consequences due to the carelessness being near the upper-range.
The mitigating factors to be considered were Mr Cameron’s very good record and the admittance of the breach.
The JCA starting point for careless riding is a term of suspension of 5 riding days. Due to the aggravating factors this was uplifted to one of 7 riding days with a one day discount being given for the mitigating matters.
