Decision:

As the breach of Rule 638(1)(d) was admitted by Ms Wenn, it was deemed to be proved by the Judicial Committee.

Penalty:

Ms Wenn’s Apprentice Jockeys Licence was suspended from the close of racing on 27 December 2016 up to and including all racing on 2 January 2017 (4 days).

Facts:

Following the running of Race 10 (Dunstan Feeds Stayers Championship Qualifier 2100), Information No. A8655 was filed with the Judicial Committee. It was alleged by the Informant that Ms Wenn allowed her mount BANROCK to shift out when not sufficiently clear of EL FERNANDO which was crowded and hampered for a distance. It stated that it occurred near the 250m.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless

Ms Wenn, in the presence of Mr Clotworthy, said that she understood the Rule, charge and confirmed to the committee that she admitted the breach.

Mr Coles showed all relevant film replays and said that Ms Wenn, when riding forward allowed her mount to shift out and crowd EL FERNANDO and shortly after, again allowed her mount to shift out and cause interference to the same runner. He said that on the first occasion VINEVALE shifted in and contributed to the incident, but that on the second shift, that there was no excuse and that Ms Wenn did not take a hold in an attempt to straighten her mount.

Mr Clotworthy, on behalf of Ms Wenn, said that there was a mitigating factor in that prior to Ms Wenn’s mount shifting, she had checked it off the heels of BLIZZARD. He added that Ms Wenn’s mount BANROCK was a green-going horse who was only having its eighth raceday start.

Submissions for Penalty:

Mr Oatham said that Ms Wenn had a very good record, with only one prior breach of the Rule during the past 12 months. He said that she had admitted the breach and that he placed the carelessness below mid-range and added that there was some movement from other runners.

Mr Clotworthy said that Ms Wenn is an Apprentice Jockey who has limited opportunities.

Ms Wenn, in answer to a question from the committee, said that she did not have any upcoming riding engagements.

Reasons for Penalty:

The committee was satisfied that interference, as alleged, had occurred, but found that there were contributing factors (other runners shifting about) which placed the degree of carelessness exhibited by Ms Wenn to be in the lower category.

Using the JCA starting point of a 5 riding day suspension for careless riding, the committee gave a discount of one day for Ms Wenn’s record and admittance of the breach.
