As the breach was admitted we find the charge proved.

Penalty:

The committee has adopted 5 days as a starting point in assessing an appropriate suspension. 

After taking all the above into account we suspend Miss Spratt's riding license from after racing 1 January and concluding after racing on 8 January (5 days).

2 January - R Tauranga

3 January - Thames JC

4 January - Otaki-Maori RC

5 January - Whangarei RC

8 January - R Rotorua

Facts:

Following Race 1, the Dunstan Feeds Championship Qualifier 2100, an Information was filed pursuant to rule 638(1)(d).  The Informant alleged that Miss Spratt allowed her mount to shift out passing the 350 metres when not clear of ROC THAT (D Johnson) which had to be checked.

Rule 638 (1) (d) reads: a rider shall not ride a horse in a manner which the judicial committee deems to be careless.

Mr Coles demonstrated on the video films Miss Spratt angling her mount out near the 350 metres to gain a clear run.  He said Miss Spratt was only 3/4 lenght clear of ROC THAT when she angled out.  He said this caused Miss Johnson to take a hold of her mount to get off the heels of MOCCONA MISS.  Mr Coles concluded the interference was not severe.

Miss Spratt had nothing to add.

Submissions for Penalty:

Mr Oatham produced Miss Spratt's record which showed 6 suspensions in the last 12 months.  He conceded the last one was in July.  Mr Oatham submitted Miss Spratt's level of carelessness in this case was low and the consequences were not great as ROC THAT was battling at the time.  He said Miss Spratt's record was not overly flash and reminded the committee the stake for the race was $50,000.  He submitted a penalty in line with those factors should be imposed.

Miss Spratt said she had commitments over the busy Christmas period up to and including 1 January 2016 and would seek a deferment until that time.  She concluded that she would like to be back for 9 January.

The committee carefully considered all evidence and submissions.  In mitigation Miss Spratt has admitted the breach and the committee finds her level of carelessness at the low end.  This was because Miss Johnson only received a minor check. 

However these factors have to be balanced against the aggravating facts which are her fair record and the race's high stake of $50,000.
