Accordingly we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Jones from riding in races which is to start after racing on 1 January 2011 and conclude after racing on 7 January 2011. (5 days)

Charge:

Careless Riding.

Facts:

Mr Williamson demonstrated the video film which showed JACKTHELAD racing in a 4 wide position approaching the 1000 metres.  At this stage the rider of JACKTHELAD, Mr B Jones, allowed his mount to shift in when insufficiently clear of HEZA REBEL on his inside which caused further crowding to FIRST EXPRESS and SHANGHAI BUND.  This resulted in SHANGHAI BUND making contact with the running rail.  Mr Williamson said Mr Jones continued to ride his mount forward and did not attempt to relieve pressure to the runners on his inside until such time that HEZA REBEL had received a sharp check. 

Submissions for Decision:

Mr B Jones told the committee his mount JACKTHELAD had hung out at its last start so obviously was still very green.  He said in todays race he was reluctant to take a hold as he felt if he had done so his mount may have ducked in accentuating the interference.  He said he had pulled off but emphasised his mount was still very green. 

Mr George said Mr Jones had made some effort to correct his mount but this was too little and too late.  He said 3 runners had suffered quite severe interference.

Reasons for Decision:

The committee considered all the evidence and reviewed the video films.  The committee is satisfied that Mr Jones was not sufficiently clear of HEZA REBEL when he moved out with resulting interference to 3 runners on his inside.  While we concede he did make some effort to straighten his mount it was too late as the interference had already occurred.

Submissions for Penalty:

Mr George said this was Mr Jones' second charge in 12 months which was a very good record.  He said the mitigating factor was that JACKTHELAD was a 2yr old and racing greenly.  However he said 3 runners had received quite severe interference but submitted because of the mitigating factor Mr Jones' carelessness was not at the top end.

Mr Jones said he had commitments until after racing on 1 January 2011.

The committre considered all submissions before imposing an appropriate penalty.  Mitigating factors are Mr Jones' excellent record, his mount was a green 2yr old and he did take some corrective action.  However the aggravating factor was that this action was far too late with resultant interference to 3 horses.  The committee explained to Mr Jones that this offence would normally have warranted a 6 day suspension but have imposed one of 5 days after taking the mitigating factors into account.
