Following Race 4, an Information was filed pursuant to rule 330 (3) (c).  The Informant, Mr Oatham, alleged that Mr M Walker, rider of SAHEEL in race 4, failed to make the contracted weight.

Following Race 4, an Information was filed pursuant to rule 330 (3) (c).  The Informant, Mr Oatham, alleged that Mr M Walker, rider of SAHEEL in race 4, failed to make the contracted weight.

Mr Walker pleaded guilty to the charge.

--

Mr Oatham told the Committee that Mr Walker could only make 53 1/2kgs in race 2 so was always going to have trouble making 52 1/2kgs.  He was replaced by Mr Peard when it was found he was going to be 1 kg over.

--

Mr Walker said he was confident of making the weight but was so hot he had to have a drink of water to look after his health.  This was the reason he was unable to make the weight.  He said he told Mr Williamson as soon as he realised.

PENALTY SUBMISSIONS

Mr Oatham said Mr Walker had only incurred one previous penalty under this rule in the last 12 months.  However this was a listed race and his obligation was to make the weight.  He submitted a fine of $200 would be appropriate.

PENALTY

The Committee considered all evidence and submissions before imposing an appropriate penalty.  To his credit Mr Walker pleaded guilty and informed Stewards as soon as possible.  However this was a listed race on a Premier Day and it is important for riders to fulfill their obligations.  Taking all the above factors into account we impose a fine of $200.
