Decision:

Following Race 2 an Information was filed pursuant to Rule 871(1) (D).

The informant Mr Oatham alleged that Mr J Jago rider of Regal Ruler permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of Desert Lad (J Waddell)

Following Race 2 an Information was filed pursuant to Rule 871(1) (D).

The informant Mr Oatham alleged that Mr J Jago rider of Regal Ruler permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of Desert Lad (J Waddell) who was dictated inwards crowding Green Jacket (M Cameron) who was checked.  Mr Jago admitted the breach.

 Mr Williamson demonstrated the video films which clearly showed Mr Jago angle his mount Regal Ruler inwards near the 1200 metres mark and in doing so take the line of Desert Lad (J Waddell) with a resultant check to Green Jacket (M Cameron).  Mr Jago was only a length to a length and a quarter clear of Desert Lad when moving in.

PENALTY SUBMISSIONS

Mr. Oatham produced Mr Jago’s record which showed 2 charges in the last 12 months.  He said it was in the lower to mid range of carelessness and submitted a 4-6 day suspension was appropriate.  Mr Jago said in his opinion the inward movement was minor and he did straighten his mount.  He said he had riding commitments until 1 January 09.

The Committee considered all submissions and before imposing a fair penalty took into account the following:

Accordingly,  we impose a suspension for Mr Jago to serve from the conclusion of racing on 1 January until after the conclusion of racing on 6 January 09 (5 days) .
