Decision: -- Following Race 2 an information was filed pursuant to Rule 871(1)(d). The informant, Stipendiary Steward Mr J Oatham alleged that Mr J Jago, rider of REGAL RULER, permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of DESERT LAD ridden by J Waddell who was dictated inwards, crowding GREEN JACKET ridden by M Cameron who was checked. Following Race 2 an information was filed pursuant to Rule 871(1)(d). The informant, Stipendiary Steward Mr J Oatham alleged that Mr J Jago, rider of REGAL RULER, permitted his mount to shift inwards near the 1200 metres when not sufficiently clear of DESERT LAD ridden by J Waddell who was dictated inwards, crowding GREEN JACKET ridden by M Cameron who was checked. Mr Jago admitted the breach. Stipendiary Steward Mr Williamson demonstrated the video films which clearly showed Mr Jago angle his mount REGAL RULER inwards near the 1200 metres and in doing so take the line of DESERT LAD with a resultant check to GREEN JACKET (M Cameron). Mr Jago was only a length to a length and a quarter clear of DESERT LAD when moving in. PENALTY SUBMISSIONS: Mr Oatham produced Mr Jago's record which showed 2 charges in the last 12 months. He said it was in the lower to mid range of carelessness and submitted a 4 to 6 day suspension was appropriate. Mr Jago said in his opinion the inward movement was minor and he did straighten his mount. He said he had riding commitments until January 1st 2009. PENALTY: The committee considered all submissions and before imposing a penalty took into account the following: 1. Mr Jago's record. 2. Mr Jago's guilty plea. 3. Level of carelessness and check received by GREEN JACKET. 4. Premier Day with a $30,000 stake payable Accordingly, we impose a suspension for Mr Jago to serve from the conclusion of racing on January 1st 2009 until after the conclusion of racing on January 6th 2009.
