Following race 9 an information was lodged pursuant to Rule 871(1)(d) when it was alleged that Mr R Norval permitted his mount TWINKLING to shift inwards shortly after the start crowding BEN HOGAN



Following race 9 an information was lodged pursuant to Rule 871(1)(d) when it was alleged that Mr R Norval permitted his mount TWINKLING to shift inwards shortly after the start crowding BEN HOGAN (J Waddell)who was checked.

Mr Norval admitted the charge.

--

Mr J Oatham showed the video film where, at the start of the race TWINKLING jumped inwards. He pointed out where Mr Norval, instead of straightening his mount, continued to ride in an inward line. In doing so he took BEN HOGAN’s line resulting in BEN HOGAN receiving a bad check.

--

As Mr Norval had pleaded guilty we are required adjudicate on penalty only.

--

Mr Cameron gave Mr Norval’s good record. He did say that we should take into account not only the degree of interference but also be aware of rule 1122 as this was a Group 1 race. He asked for a suspension of 6 – 8 days with a fine of $500 - $1000 as well.

Mr Norval had nothing to add.
