Decision:

Following Race 2 a protest was lodged Mr B Wallace pursuant to Rule 876(1) when it was alleged that NUKE TIME or its rider placed 1st by the Judge interfered with the chances of ENCANTADA placed 2nd by the Judge.



Following Race 2 a protest was lodged Mr B Wallace pursuant to Rule 876(1) when it was alleged that NUKE TIME or its rider placed 1st by the Judge interfered with the chances of ENCANTADA placed 2nd by the Judge.

The interference occurred in the final straight.

--

The Judges margin between 1st and 2nd was a short head.

--

Present were Mr B Wallace and A Peard representing ENCANTADA

--

Mr D Ellis and M Walker represented NUKE TIME

--

The informant, Mr B Wallace, demonstrated the video films and showed NUKE TIME with ENCANTADA racing on its outside soon after entering the straight. Both of the horses had clear vision ahead. As they progressed down the straight NUKE TIME could be seen to move across ENCANTADA’s line. As they progressed closer to the winning post ENCANTADA had to change ground to come round NUKE TIME and got to within a short head of the winner.

Mr Walker, the rider of NUKE TIME, showed the side – on video where, in his opinion he was always at least a clear length ahead of ENCANTADA when he moved out and at no time did he hinder the horse. At no time could Mr Peard be seen to stop riding ENCAANTADA during NUKE TIME’s outward movement.

Mr Ellis thought that it was significant that the protest was not initiated by the Stipendary Stewards. He also claimed that there was always two lengths between the two horses and also observed that Mr Peard could not be seen to have stopped riding his mount out.

Chief Stipendary Steward Mr C George, when asked for his observation said that, in his view during NUKE TIME’s outward movement there was always a clearance between the two horses and that Mr Peard could not be seen to stop riding.

After reviewing the evidence, including the videos, the committee find that at no time did NUKE TIME hinder ENANTADA by taking it’s line in the straight because it was always the required distance clear during the movement.

The protest is therefore dismissed and the Judges places will stand.
