DECISION & REASONS:

This information alleged a breach of Rule 871(1)(d) for careless riding by apprentice jockey, C. Parish (TONY THE PONY), in that he shifted inwards after the start when not sufficiently clear of SARAJAY (T. Harris). The breach was admitted and Mr.Parish, being an apprentice, was assisted by Jockey C. Lammas.

Assistant Stipendiary Steward, W. Robinson, demonstrated the incident on video, pointing out the inward movement shortly after the start as TONY THE PONY was ridden forward. As he did so he put pressure on SARAJAY on his inner on at least three occasions failing to take any action to relieve the pressure. Further on he affected Jockey G. McKeon (ELFERON). Mr. Parish confirmed that his mount had lugged in a bit as he was pushing up from the start and he accepted that he had misjudged the distance. Mr. Lammas asked the committee to note that TONY THE PONY was going awkwardly for its rider and he knew from his own experience it was difficult to ride. He felt, given the circumstances, it could be treated as an error of judgment on the part of Mr. Parish.

Mr. Coles asked the Committee to take note that Mr. Parish had a lot of rides and his only previous suspension had been for three days at Ruakaka on 27 June 2005. It was accepted as an error of judgment on his part but contact had occurred on at least three occasions and had cost SARAJAY quite a lot of ground and affected its chances quite badly. Therefore, he believed, a period of suspension ought to be imposed.

The Committee took into consideration these matters and giving credit for the guilty plea and good record agreed that suspension should be imposed because it was a severe check. Suspension for three days was ordered to take effect from the conclusion of racing on 27 December 2005 until the conclusion of racing on 1 January 2006.
