PROTEST:
--Following race 4 a protest was lodged pursuant to rule 642(1). The informant Mr A Peard, rider of the second horse I’M ISAAC alleged that the first horse MISSING LINK interfered with his chances in the final straight.
----
The distance between first and second was a short neck.
----
SUBMISSION(s):
--Mr Peard demonstrated the video films and pointed out to the hearing his mount I’M ISAAC and the winner THE MISSING LINK, both drifting in and out in the last 150 metres. Mr Peard said he had to put his stick away for a stride when THE MISSING LINK dictated his line outwards. He said in the last 50 – 60 metres he was forced out 4 – 5 horse widths.

Mr Pender, trainer of I’M ISAAC, said the 6 kilos extra weight his horse was carrying coupled with being forced over extra ground was the difference between running first and second.

Mr Kasim, rider of THE MISSING LINK, admitted moving out but said most of the field was doing likewise. He said at the 200 metres he got close to I’M ISAAC but there was no contact between them. Mr Kasim said that at no stage did Mr Peard stop riding and said his own horse was just too strong for I’M ISAAC.

Mr Peterson, trainer of THE MISSING LINK, said the weight difference was irrelevant and that I’M ISAAC was under a hard ride over the last 200 metres. He said it was clear on the film that Mr Peard did not stop riding at any stage.

Mr Williamson, when asked for his appraisal of the protest, said that while I’M ISAAC was inconvenienced Mr Peard did not have to stop riding. He said I’M ISAAC was forced over extra ground but that THE MISSING LINK was always holding I’M ISAAC over the final stages. He said the committee had to decide whether the inconvenience to I’M ISAAC cost him winning the race.

Mr Peard, in summing up, said THE MISSING LINK’S head was turned out demonstrating his outward movement which he believed cost him the race.

The defendant, Mr B Peterson had nothing further to say.

DECISION:
--Before reaching a correct decision the committee considered all the evidence as presented and reviewed the video films. While the committee concedes that I’M ISAAC was inconvenienced by THE MISSING LINK it was evident that Mr Peard did not stop riding I’M ISAAC at any stage. It was clear there was no contact between the 2 horses and that THE MISSING LINK was always holding an advantage in the last 50 metres or so. In fact he was increasing that lead at the post.

For these reasons the committee is not satisfied that I’M ISAAC would have beaten THE MISSING LINK if interference had not occurred.
----
Accordingly the protest is dismissed and the judge’s placings shall stand.
