| -- REQUEST FOR RULING --Mr Kevin Myers, trainer of BALMUSE in Race 8, applied by telephone to late scratch the horse due to the existing track conditions. Stipendiary Steward Coles declined to exercise his discretion under Rule 828(8)(a) and has filed this information for the judicial committee to determine whether there are such circumstances that would entitle late scratching of the horse. ----Mr Myers was represented by Jockey David Walker who explained that the circumstances, which he and Mr Myers believed, warranted the horse being scratched were the excessive heaviness of the track, which was believed to be too testing for the horse at this stage of its preparation. Mr Walker had ridden in Race 5 over 1600 metres and noted that the time was 1.45. This was the first time for the horse to race at the distance of 2000 metres and it was felt it was too much to ask of it at this stage. The connections were aware the track would be heavy given the pentrometer reading of 4.7 but further rain on the day must have made it heavier. He confirmed that BALMUSE had won in heavy ground but this had been over 1200 metres. ----Mr Coles confirmed that there had been no change in the official track conditions and any rain since the start of racing for the day, in his opinion, would make the track looser if anything. ----The committee having considered these matters is satisfied there has been no material change in the condition of the track to entitle scratching BALMUSE and the application is therefore declined. |
