As Mr Grylls admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Grylls’ suspension pursuant to Rule 1106(2).

Accordingly, Mr Grylls had his license to ride in races suspended for a period to commence after racing on 1 June and conclude after racing on 13 June 2019.

The race meeting at Taranaki on 6 June was not included in penalty because it is scheduled for Highweight / Jump riders and apprentices only.

Facts:

Following the running of race 2, Race Images 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Grylls allowed his mount CAMPARI to shift in when not sufficiently clear of COME BACK TIGER which was checked passing the 200 metres.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Grylls said he understood the Rule and confirmed that he admitted the breach.

Mr Oatham demonstrated the incident using the available video footage. He said the incident had been fully covered during an earlier protest hearing. He identified that Mr Grylls allowed his mount to shift in near the 250 metres when not sufficiently clear. As result COME BACK TIGER was dictated inwards when Mr Grylls allowed his mount to shift in further. He said in mitigation there was some minor pressure from the inside which contributed to the incident.

Mr Grylls said that he felt he didn’t shift in much but accepted that he rode in a careless manner. He said the inside horses contributed to the incident.

Submissions for Penalty:

Mr Oatham produced Mr Grylls' record which showed 2 previous breaches under this Rule in the last 12 months. He said to Mr Grylls' credit was his admission of the breach and he described the level of carelessness as low range. He stated the aggravating factor was as a result of Mr Grylls’ carelessness CAMPARI was relegated from 1st place. He said Mr Grylls’ record was a neutral factor and submitted a low range suspension would be appropriate.

Mr Grylls requested a 7 day deferment to his proposed suspension so could fulfil his engagements at Ellerslie on 1 June.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

It was clear on the video films that Mr Grylls permitted his mount to shift inwards near the 200 metres when only ¾ of a length clear of COME BACK TIGER. As a result that runner was crowded and checked losing approximately 2 lengths. Mr Grylls made no discernible effort to correct his mount when it shifted inwards. We accept that there was some slight outward movement from the horses to his inside.

The Committee deemed the level of carelessness displayed by Mr Grylls was low range.

The JCA Penalty Guide starting point for low range carelessness is 6 national days which was adopted.

The aggravating fact was CAMPARI being relegated from 1st place for causing interference to COME BACK TIGER. This warranted a 1 day uplift in penalty.

The mitigating factors were Mr Grylls’ admission of the breach and his relatively good record. For these collective factors Mr Grylls was afforded a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
