Decision:

As Mr Cameron admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted a deferment to Mr Cameron’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Cameron had his license to ride in races suspended for a period to commence after racing on 27 January and conclude after racing on 13 February 2020.

Facts:

Following the running of race 4, Karaka Million 2YO, (Restricted Listed Race) an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Cameron permitted his mount DRAGON QUEEN to shift out when not sufficiently clear of DE LA TERRE approaching the 250 metres which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Cameron said that he understood the Rule and confirmed that he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that approaching the 250 metres DRAGON QUEEN was racing on the heels of AMOR FATI. He said that Mr Cameron angled his mount out into the running line of DE LA TERRE who was improving to its outside. He noted that Mr Elliot had to stand up in the saddle and take a hold of DE LA TERRE.

Mr Cameron said that he agreed in part with Mr Coles’ assessment of the incident. He said that he did hear Mr Elliot call out to him but at the same time he was awkwardly placed on the heels of AMOR FATI. He said that he never rode his mount out but rather it was a case of his mount shying away from the heels of AMOR FATI. He added that he took corrective action but his horse was young and green.

Submissions for Penalty:

Mr Oatham produced Mr Cameron's record which showed 1 previous breach under this Rule in the last 12 months, this occurred on 9 March 2019 at Ellerslie. He advised that Mr Cameron has since had 517 rides and therefore his record was very good. He said the carelessness was below mid-range and a contributing factor was that AMOR FATI was weakening back onto DRAGON QUEEN. He said that aggravating factor was the breach occurred is a Restricted Listed race worth 1 million dollars.

Mr Cameron said that any proposed suspension could start after racing on 27 January at Te Teko.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The video films showed that Mr Cameron angled his mount outwards to avoid the heels of the weakening AMOR FATI passing the 300 metres. In doing so he was only 3/4 to 1 length clear of DE LA TERRE which was checked and lost ground. We accept that DRAGON QUEEN reacted ungenerously when Mr Cameron steadied his mount to avoid the heels of AMOR FATI.

The Committee deemed the level of carelessness was low to mid-range. The JCA Penalty Guide starting point of 7 national riding days was adopted.

Under the provisions of Rule 920(2) the aggravating factors were the breach occurred in a Restricted Listed Race worth 1 million dollars which is the equal richest race on the NZ racing calendar. For this we applied a 4 day uplift in the penalty.

The mitigating factors were Mr Cameron’s admission of the breach and his excellent record for a busy rider. For these combined factors Mr Cameron was afforded a 2 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 9 national riding days.
