Mr Riddell has admitted the breach and it is therefore proved.

Penalty:

Accordingly, we impose a 6 day suspension on Mr Riddell which will commence after racing on 31 January 2015 and conclude after racing on 12 February 2015 (6 North Island race days).

Note – The Committee originally directed the suspension end after racing on 13 February 2015, but this was changed to 12 February 2015 after it was pointed out that we omitted to include a Northern meeting in our calculation. 

Facts:

Following the running of Race 2, the Windsor Park Stud Karaka Stayers Cup, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Oatham alleged that Senior Rider J Riddell “permitted his mount DEANE MARTIN to shift outwards when not sufficiently clear of ROSE OF VIRGINIA which was checked near the 250 metres”.

Mr Riddell acknowledged that he understood the nature of the charge and the Rule. He also confirmed his admission of the breach.

Rule 638(1) (d) provides that:

A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Co-Chief Stipendiary Steward Mr R Neal identified the alleged incident using available video footage. He said that shortly after the field entered the home straight Mr M Du Plessis the rider of ROSE OF VIRGINIA was searching for a run near the outer of DEANE MARTIN. At the same time DEANE MARTIN shifted outwards under pressure and checked ROSE OF VIRGINIA who was laying in slightly. Mr Neal said that when shifting out, Mr Riddell continued to ride his mount forward when barely a length clear of ROSE OF VIRGINIA. He added that DEANE MARTIN shifted out at least 4 to 5 horse-widths.

Mr Riddell advised the Committee that his mount was a difficult ride and his racing manners were a contributing factor. He said that when he shifted out he did not realise Mr Du Plessis was behind him and would have expected him to call out if things got tight. Mr Riddell said once his horse started to shift out there was not much he could do about it. 

Submissions for Penalty:

Mr Oatham produced Mr Riddell's record which showed 4 previous breaches under this Rule in the last 12 months, the most recent being on 1 January 2015 at Ellerslie which attracted a 6 day suspension. He said that Stewards rated the level of carelessness at mid-range, but accepted Mr Riddell's submission that his mount was a difficult ride. In terms of penalty Mr Oatham asked the Committee to note that the race carried a stake of $100,000 and that a suspension in the 5-7 day range would be appropriate.

Mr Riddell submitted that the level of carelessness was minimal and the racing manners of his mount did not help his situation, despite him making an effort to straighten and balance his mount. Mr Riddell accepted that his recent riding record was “not flash” in relation to the careless riding rule.

In response to a query from the Committee Mr Riddell advised that he had riding commitments through to 31 January 2015 and sought a deferment to any proposed suspension. Mr Riddell confirmed that he was a North Island (Northern and Central Districts) rider. 

Reasons for Penalty:

In assessing penalty the Committee has taken into account the overall circumstances of the breach itself as well as the particular circumstances relating to Mr Riddell. The Committee also considered penalties handed out for similar breaches and are mindful of the fact that breaches of similar culpability should, as a general rule attract broadly similar penalties.

The Committee has also factored into our decision the requirements of R 920 (2), which provides that:

(2) On finding a breach proved the Judicial Committee may impose any penalty provided by these Rules. In imposing a penalty provided in these Rules the Judicial Committee may have regard to such matters as it considers appropriate including:

(a) the status of the Race;

(b) the stake payable in respect of the Race;

(c) any consequential effects upon any person or horse as a result of the breach of the Rule;

and/or

(d) the need to maintain integrity and public confidence in racing.

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in consideration of a term of suspension. We accept the submissions of both Mr Oatham and Mr Riddell that the horse's racing manners were a mitigating factor. The aggravating factors include Mr Riddell's riding record which we assess as being only fair, this being his 5th breach in 12 months and 3rd breach of the rule within 5 weeks. The Committee reviewed the film and assessed the level of carelessness as mid-range and note the race carried a stake of $100,000.

After taking into account all the above factors we consider an appropriate penalty is a 7 day suspension and have treated Mr Riddell as a North Island (North and Central districts) rider. We give Mr Riddell 1 days credit for his admission of the breach and the fact that his mount was a contributing factor thus reducing the suspension by 1 day.
