As Miss Holmquist admitted the breach we find the charge proved.
Penalty:
We grant Miss Holmquist's request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Miss Holmquist which will commence after racing on 28 May and conclude after racing on 5 June (5 North Island days).
Facts:
Following the running of race 1, Broderick Print 2400, an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr Williamson, alleged that Miss Holmquist permitted her mount FAIR FLEET to shift inwards when not sufficiently clear of DELICIANO which was checked near the 1850 metres.
Miss Holmquist acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Mr Somervell assisted Miss Holmquist at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles identified on the video films FAIR FLEET racing four wide as the field approached the 1850 metres. He said Miss Holmquist allowed her mount to shift in when only three quarters to one length clear which caused DELICIANO to check off the heels of TE KINGI. He added the incident was due to an error of judgement by Miss Holmquist.
Miss Holmquist told the Committee that she sought to shift inwards and in doing so took the rightful running line of DELICIANO.
In response to a question from the Committee, Miss Holmquist admitted she didn’t realise that DELICIANO was racing to her inside.
Mr Somervell said that he should take some blame for the incident because Miss Holmquist may have over reacted to his riding instructions. Mr Somervell said he told Miss Holmquist that he did not want her to be caught three or four wide going out of the straight. He asked the Committee to note this was Miss Holmquist's first ride at Ellerslie.
Submissions for Penalty:
Mr Williamson produced Miss Holmquist's record which showed no previous breach under this Rule from her twelve raceday rides. He said the interference to DELICIANO caused that horse to clip heels and blunder. He described both the level of carelessness and impact were in the mid – to high range. He accepted the breach was due an error of judgement and ought to be dealt with by way of a suspension in the five to seven day range.
Miss Holmquist advised that she had upcoming commitments at Counties on 28 May and any proposed suspension could commence after that. She had nothing further to add.
Mr Williamson advised the Committee that Miss Holmquist should be treated as a North Island rider for the purpose of assessing the proposed penalty.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Holmquist’s admission of the breach, her good record in relation to this Rule albeit this was her thirteenth raceday ride and her inexperience as an apprentice rider. The aggravating fact is DELICIANO was checked and as a result clipped the heels of TE KINGI, blundered and lost ground. We assess the level of carelessness as mid – range.
After taking into account all the above factors the Committee considers an appropriate penalty is a five day suspension.
