Decision:

Following Race 6 an information was filed pursuant to Rule 871(1)(d) by the Informant, Mr A Coles.     He alleged that near the 100 metre mark TZUHALEM (J McDonald) shifted in  when not clear of GOLDIES POST (J Waddell) resulting in that horse having to be checked.

Following Race 6 an information was filed pursuant to Rule 871(1)(d) by the Informant, Mr A Coles.     He alleged that near the 100 metre mark TZUHALEM (J McDonald) shifted in  when not clear of GOLDIES POST (J Waddell) resulting in that horse having to be checked.

Mr McDonald denied the charge and was represented by Trainer, Mr R Elliott.

Mr Williamson demonstrated the video films and showed where at the 100 metre mark TZUHALEM (J McDonald) move in approximately one horse width and take the line of GOLDIES POST (J Waddell) when insufficiently clear of that runner.    This caused Mr Waddell to take hold of his mount for 4-5 strides.

Mr Waddell, rider of GOLDIES POST was called as a witness and said that 100 metres from the post TZUHALEM shifted in and took his line for 4 to 5 strides.

Mr Elliott on behalf of Mr McDonald, said TZUHALEM only moved in half a horse width, but believed that GRIM REAPER on the inside of TZUHALEM had moved in and made the gap for GOLDIES POST.

Mr McDonald had nothing to add.

Mr Coles said GOLDIES POST was entitled to move into the gap which was available.  He said that TZUHALEM than moved in and took GOLDIES Post’s line when only three-quarters clear of that runner causing Mr Waddell to check his mount.

Decision:

The committee considered all evidence and reviewed the video films.

We are clearly satisfied that Mr McDonald did allow his mount TZUHALEM to move in and take the line of GOLDIES POST when insufficiently clear of that runner.   Accordingly we find the charge proven.

Penalty:

Mr Elliott said he believed it was at the lowest end of carelessness and asked for the minimum.

Mr Coles produced Mr McDonald’s record which showed two recent charges resulting in a four and six day suspension.   He believed this charge warranted a 4-6 day suspension.

The committee considered these submissions and before imposing penalty considered the following –

1.         Mr McDonald’s riding record which we advised him to be aware of.

2.         Degree of carelessness which we concede was at the lower end.

3.         Mr McDonald’s future commitments.

Accordingly, we impose a suspension to start after racing on the 26^th of March 2008 and conclude after racing on the 3^rd April 2008 – 5 days.
