Decision:

Following Race 3 an information was filed by Mr A Coles, under Rule 871(1)(d).   He alleged that RUM ‘n’ RICE (S Patchimuthu) shifted in sharply under pressure resulting in a check to SO UNIQUE (A Peard) and resultant tightening to LADY OF PETERSBURG (M Sweeney).  



Following Race 3 an information was filed by Mr A Coles, under Rule 871(1)(d).   He alleged that RUM ‘n’ RICE (S Patchimuthu) shifted in sharply under pressure resulting in a check to SO UNIQUE (A Peard) and resultant tightening to LADY OF PETERSBURG (M Sweeney).   This occurred near the 400 metre mark.

Mr Patchimuthu pleaded guilty and was represented by Mr A Peard.

Mr Williamson demonstrated the video film and showed at the 400 metre mark Mr Patchimuthu riding RUM ‘n’ RICE allow his mount to move in sharply when using the whip.   This inward movement caused quite a sharp check to SO UNIQUE on his inside which in turn tightened LADY OF PETERSBURG.   Mr Williamson said Mr Patchimuthu continued riding with the whip, which the Stewards deemed careless.

Mr Coles said this was Mr Patchimuthu’s first charge but there was significant movement from him and he continued riding forward hitting his mount a second time.    He suggested a suspension of 4-5 days would be appropriate.

Mr Peard asked the committee to consider Mr Patchimuthu’s inexperience and that it was the horse’s first start.

Penalty:

The committee considered all submissions and before imposing a penalty took into account the following –

--

1.            Mr Patchimuthu’s first charge.

--

2.            His inexperience

--

3.            The horse’s greenness.

--

4.            The severity of the check to SO UNIQUE.

--

Accordingly, we impose a suspension to start after racing on the 26th of March 2008 and conclude after racing on the 3rd of April 2008 – 4 days.
