Following race 10 an information was filed pursuant to rule 638 (3) (b).  The informant Mr Coles alleged that Miss Spratt, rider of AZINCOURT, used the whip in a manner deemed to be excessive.

FACTS:

--

Mr Williamson demonstrated the video films which clearly showed Miss Spratt, riding AZINCOURT, was in front turning for home.  From this point on it was evident that Miss Spratt struck her mount 16 times before the 200 metres without giving the necessary respite under the whip guidelines.

SUBMISSION(s):

Miss Spratt said that in admitting the breach she was unaware she had hit her mount so many times in succession.

SUBMISSION(s) ON PENALTY:

Mr Coles said this was Miss Spratt’s 2nd charge under this rule in the last 12 months and submitted a fine of between $250 and $350 would be appropriate.

Miss Spratt had nothing to add.

The committee considered all evidence and submissions before imposing a penalty.  In particular we considered Miss Spratt’s admission of the breach and her record under this rule.  As her last whip charge incurred a $250 fine we believe a small increase on this penalty is necessary.

Accordingly we impose a fine of $300.
