As Ms Johnson admitted the breach the Committee find the charge proved.

Accordingly, Ms Johnson had her license to ride in races suspended for a period to commence after racing on 27 May and conclude after racing on 1 June 2015 (5 days).
Facts:
Following the running of race 3 Equilme 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Johnson allowed RAMARRO to shift out near the 600 metres when not clear of SIERRA BEEL which had to be checked losing ground.
Ms Johnson acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the video footage which showed RAMARRO racing in a 1 off position near the 600 metres with SIERRA BEEL racing approximately ¾ of a length behind on her outside. He identified that Ms Johnson looked to her outside on 2 occasions before electing to angle out to a 3 wide position. This resulted in Mr Colgan having to take a hold of his mount causing him to lose about 1 length. He believed Ms Johnson misjudged the situation.
Ms Johnson conceded that it was rider error as she was under the impression that Mr Colgan’s mount was weakening. She said this was the reason she eased her mount out.
Submissions for Penalty:
Mr Williamson produced Ms Johnson’s record which showed 6 previous breaches under this Rule in the last 12 months the most recent being 28 March which incurred a 6 day suspension. He said the level of carelessness was low end and a suspension in line with that would be appropriate.
Ms Johnson advised that she had upcoming engagements at Te Aroha on 27 May and sought a deferment to any proposed suspension. She told the Committee that she was going hard to chase the premiership and had instructed her Manager to start sourcing rides in the South Island.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors were Ms Johnson’s admission of the breach and the level of carelessness was low end. The aggravating fact was Ms Johnson’s poor record under this Rule even taking into account she is a busy rider.
The Committee was satisfied that Ms Johnson has a recent history of riding in the Central Districts on Industry days. However, we are aware that Ms Johnson does not have a recent history of riding in the South Island. The Committee in this particular case was satisfied that because Ms Johnson is going to be chasing the premiership this would include South Island meetings in the near future. We reminded Ms Johnson of her credibility regarding her intention to ride at the up – coming South Island race meetings.
After taking into account all the above factors the Committee considers an appropriate suspension is 5 days.
