--Following Race 7 an Information was filed pursuant to Rule 638(1) (d).The informant, Mr A Coles, Stipendiary Steward, alleged that near the 1750 metres MARCIANO (C Ormsby) shifted in, when not clear of TIMEKEEPER (A Calder) who was placed in restricted room and then checked.

--Following Race 7 an Information was filed pursuant to Rule 638(1) (d).The informant, Mr A Coles, Stipendiary Steward, alleged that near the 1750 metres MARCIANO (C Ormsby) shifted in, when not clear of TIMEKEEPER (A Calder) who was placed in restricted room and then checked.
--Mr Ormsby did not admit the breach.
--Mr C George, Chief Stipendiary Steward demonstrated the video films which clearly showed, nearing the 1750 metres, Mr Ormsby riding MARCIANO allows his mount to shift inward when insufficiently clear and cause crowding to TIMEKEEPER ridden by Mr Calder, who was forced to relinquish his rightful running line. Mr George said at the time of the incident Mr Ormsby was only ¾ length clear.
--Mr Ormsby had no questions of Mr George interpretation of the video films.
--Mr Calder, rider of TIMEKEEPER was called to give evidence. Mr Calder said he suffered interference from MARCIANO ridden by Mr Ormsby when he shifted ground inwards. He said he had to steady his mount off the heels of Marciano and believed Mr Ormsby was only ¾ length clear at the time of the incident.
--Mr Ormsby asked Mr Calder if his mount was pulling at the time of the incident, Mr Calder said his mount was pulling only when he had to restrain it from avoiding MARCIANO’S heels. Mr Ormsby then asked Mr Calder whether he believed the pace slackened at the time of the incident. Mr Calder said he believed the pace did not slacken.
--Mr Ormsby said that his horse was green and believed he was receiving pressure from No Emotion who was racing on his outer and this dictates him inwards, making him take a position earlier than he wanted. He conceded that Mr Calder did receive crowding causing him to check his mount but did not believe it was due to his inward movement.
--Mr Coles in summing up said there was always a gap between NO EMOTION and MARCIANO and the video films do not back up Mr Ormsby’s assessment of the incident. He said Mr Calder was already clearly crowded by Mr Ormsby‘s mount shifting inwards when not the required distance clear.
--DECISION
--The Committee carefully considered all the evidence and submissions.
--We believe the video films clearly showed that Mr Ormsby did shift in when insufficiently clear causing crowding to TIMEKEEPER ridden by Mr Calder forcing him to take a strong hold of his mount, in which he had to relinquish his rightful running line. The Committee considered Mr Ormsby’s belief that he received pressure from his outside which contributed to the incident. However, it is evident on the video films that there was always a clear gap on his outer and this did not have a bearing on the incident. Because Mr Ormsby was not the required distance clear of Mr Calder when moving in we find the charge proven.
--PENALTY SUBMISSIONS
--Mr Coles produced Mr Ormsby’s record which showed 3 charges under this rule in the last 12 months. He said Mr Ormsby had a reasonable record and submitted a 4 day suspension would be appropriate. Because MARCIANO finishing unplaced in the Group 2 race no fine was submitted for Mr Ormsby by the Stipendiary Stewards.
--Mr Ormsby said he had firm commitments at Avondale on February 24th 2010 and at Matamata on February 27th 2010, and would like the suspension to start after racing at Matamata.
--PENALTY
--The Committee carefully considered all the evidence and submissions presented. We took into account Mr Ormsby’s reasonable record, the level of carelessness being in the lower range, and the status of the race Group 2.We grant Mr Ormsby’s request that the suspension starts after racing on February 27th 2010.
--Accordingly we impose a suspension on Mr Ormsby from riding in races to start after racing on February 27th 2010 and to conclude after racing on 6th March 2010 (4 Days)
