This is a protest under Rule 876 (1) of the Rules of Racing by Stipendiary Steward A R Coles following Race 9 alleging that COOL TALK or its rider placed third by the judge interfered with the chances of ADESSO placed fourth.
| -- DECISION & REASONS: --This is a protest under Rule 876 (1) of the Rules of Racing by Stipendiary Steward A R Coles following Race 9 alleging that COOL TALK or its rider placed third by the judge interfered with the chances of ADESSO placed fourth. The interference was alleged in the final straight and the margin between third and fourth was three quarters of a length. Mr. Coles reserved the right to charge. ----The connections of COOL TALK were represented by Trainer Lance O?Sullivan and those of ADESSO by its Trainer Royce Dowling. ----Stipendiary Steward J Oatham demonstrated the incident on video. He drew attention to contact occurring on two separate occasions as COOL TALK moved out on to ADESSO which was finishing strongly on its outside. The second incident he described as quite severe and caused the rider to take a drastic hold by which stage it was within a neck of COOL TALK. ----Mr. O?Sullivan questioned whether there had been any prior movement inwards by ADESSO. Mr. Oatham said it was minimal and it was entitled to do so in his opinion. He did not believe it had any bearing on the contact which occurred later. ----Mr. O?Sullivan stated there had to be some doubt about whether the prior movement had contributed to the incident and in that case his horse was entitled to the benefit of it. He also invited the committee to consider whether, given the margin of three quarters of a length, the chances of ADESSO had been affected. ----Mr. Dowling asked the rider of ADESSO, Jockey C. Lammas, to state what he had experienced and he confirmed he was going good enough at the time and improving until the contact denied him any chance of a better placing. He insisted that there had been no prior movement inwards by his mount. ----Mr. Coles in summing up told the committee he believed the evidence established that interference had occurred as alleged and in particular the second incident which resulted in Mr. Lammas having to take a hold which, in his view, had cost him more than the three quarters of a length of the official margin at the finish. ----After considering the above the Committee accepts the evidence of Mr. Oatham and Mr. Lammas and is satisfied that interference has occurred as alleged; and that it has affected the chances of ADESSO. It does not agree with the interpretation of Mr. O?Sullivan. Accordingly the committee exercises its discretion to change the placings, the protest is upheld and the amended placings will now be: ----1st No.4 CALL IT THE BLUES --2ND No. 9 ANCHOR ME --3RD No.15 ADESSO --4TH No. 14 COOL TALK --5th No.12 ROSE OF ARCADIA -------- -- --
