As the charge was admitted it was deemed to be proved by the Judicial Committee.

Penalty:

The Committee notes that Mr Waddell had his licence to ride in races suspended at Matamata RC on 23 February for a period to commence after racing on 2 March and conclude after racing on 10 March 2019.

Mr Waddell’s Jockey’s Licence was suspended from the close of racing on 10 March up to the cessation of racing on 27 March 2019 (12 days).

Facts:

Following the running of Race 9 (Vodafone NZ Derby Group 1) Information No. A12145 was lodged with the Judicial Committee. It was alleged by the Informant that Mr Waddell the Rider of VERNANME directed his mount out near the 700m when insufficiently clear of THE CHOSEN ONE which was checked.

Rule 638(1)(d) provides:

A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

careless

Mr Waddell said that he understood the Rule and confirmed that he admitted the breach.

Mr Coles showed the film replays and said that near the 700m VERNANME was racing against the running rail with THE CHOSEN ONE to his outside. He said that Mr Waddell then rode forward and out from the rail when not clear and that THE CHOSEN ONE was checked. He said that VERNANME had shifted to a 3-wide position.

Mr Waddell said that the horse he had been following, TOLEMAC, shifted off the fence and that that made him go a little wider. He said that that was a mitigating factor.

Submissions for Penalty:

Mr Oatham produced Mr Waddell’s record which showed 5 previous careless riding charges in the last 12 months with one of those being in Australia. Mr Oatham placed the carelessness in the mid-range and said that a significant aggravating factor was that it occurred in a Group 1 Race with a $1,000,000 stake. He invited the Committee to factor those matters into the decision.

Mr Waddell said that he had let himself down terribly as he had been riding for four months with no charges laid against him. He said that today was a terrible let-down and that it will not come light and that he would cop it on the chin.

Reasons for Penalty:

The Committee was satisfied that Mr Waddell had shifted away from the running rail when not the required distance clear (2 lengths) of THE CHOSEN ONE near the 700m and as a consequence THE CHOSEN ONE was checked. The Committee placed the carelessness in the low to mid-range category and adopted a 7-day starting point in keeping with the JCA Penalty Guideline, with a discount of one day being given for the admitted breach. The aggravating factors were Mr Waddell’s record for which an uplift of 2 days was given with a further 4 days imposed due to the careless riding occurring in a Group 1 Race with a stake of $1,000,000 on offer. This is in accordance with the provisions of Rule 920(2).

The Committee took into account the Premier race meetings Mr Waddell would miss during his suspension.
