Facts:
Following the running of Race 4 (Go Racing Syndications 1500) Information No. A12142 was filed with the Judicial Committee. It was alleged by the Informant that Mr Grylls had allowed his mount THE BANDITO to shift out near the 350m when not clear of GINO SEVERINI which was checked.
Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be : careless
Mr Grylls confirmed that he understood the Rule and that he admitted the breach.
Mr Balcombe showed the film replays and said that Mr Grylls came out into the line of GINO SEVERINI near the 350m when not clear and as a consequence GINO SEVERINI was checked.
Mr Grylls said that he had admitted the breach but wished to point out that his horse stepped out a little further than he had anticipated and that he had only intended to come out gradually. He added that he had been careless when shifting.
Submissions for Penalty:
Mr Oatham said that Mr Grylls had had 3 suspensions in Singapore in the last 12 months and since resuming riding in New Zealand he had had 110 rides with a clear record. He said that his record was a neutral factor and placed the carelessness in the mid-range.
Mr Grylls said that he had a pretty good record and is usually a careful rider, but that he had erred on this occasion. He asked for a 7-day deferment.
Reasons for Penalty:
The Committee placed the carelessness in the mid-range category. The JCA starting point for such carelessness is an 8-day suspension which the Committee adopted. Taking into account Mr Grylls’ record and the admittance of the breach it was determined that a 7 riding day suspension was an appropriate penalty.
