Facts:

Prior to the running of Race 10 (Vertical Logistics 2100) Information No. A12141 was filed with the Judicial Committee. It was alleged by the Informant that Trainers S and E Clotworthy failed to scratch DELEGATE by the required time.

The Trainers admitted the breach and signed the Information stating that they did not wish to be present at the hearing.

Mr Oatham said that DELEGATE was an Acceptor in both Race 5 and Race 10 on the programme. He said that DELEGATE was balloted in Race 10 but had made the field some three hours following acceptance time. He said that Mr S Clotworthy had told him that he had forgotten about scratching from one of the races. He said that Mr Clotworthy had heard his phone ringing on Saturday morning but did not answer it as there are strict rules in place at Byerley Park regarding the use of phones. Eventually he was able to be contacted by phone with DELEGATE being scratched at 8.06am. (Scratching time was 7.30am). Mr Oatham said that due to not being scratched on time all scratchings for the meeting were late being published on the NZTR website.

Mr Oatham outlined previous penalties for breaches under the Rule which ranged from $150 - $200. He added that there were aggravating factors to be considered for this breach.

Reasons for Penalty:

The JCA Penalty Guideline has a starting point of $200. Taking into account all matters in relation to this breach of the Rule the Committee determined that a fine of $250 was a suitable penalty.
