CHARGES:
--Following race 1 an Information was filed pursuant to Rule 330(3)(c). The informant, Stipendiary Steward Mr J Oatham alleged that Miss Rattley failed to make the contracted weight for DON DIXIT. Miss Rattley admitted the breach.

FACTS:
--Mr Oatham explained to the Committee that Miss Rattley the declared rider for DON DIXIT was found to be 2kgs overweight. He was aware that Miss Rattley had attempted to get down to the contracted weight. This resulted in Miss Rattley being replaced by Miss J Whiteside.

REASON(s):
--Mr Ritchie who spoke on behalf of Miss Rattley said he was aware that Miss Rattley had spent 2 hours in the sauna on Friday and another 1 hour on Saturday morning in an attempt to make the contracted weight.
----
SUBMISSIONS(s) ON PENALTY
--Mr Oatham said that Miss Rattley had given a genuine attempt to make the weight , however, he said a late rider change was not ideal. Mr Oatham said Miss Rattley had no previous breach under this rule and submitted a fine of $100 - $200 would be appropriate.

Mr Ritchie when invited to make submissions on penalty asked for leniency.

REASON(s):
--The Committee carefully considered all evidence and submissions as presented. Mitigating factor is Miss Rattley’s admission of the breach and her first charge under this rule. However, the Committee pointed out to Miss Rattley that it is more difficult to lose weight in the winter months.
----
PENALTY:
--After taking all the above factors into account we impose a fine of $150.
