As Mr Tanaka admitted the breach we find the charge proved.
Penalty:
Accordingly we impose a suspension on Mr Tanaka which will commence after racing on the 25th February 2012 and to conclude after racing on 5th March 2012 ( 5 days).
Charge:
Following race 6 an information was filed pursuant to Rule 638(1)(d). The informant Mr George alleged that near the 400 metres Mr Tanaka (TILDA) allowed his mount to shift out dictating SHUKA across the heels of CARRICK which resulted in SHUKA (H Tinsley) being checked.
Facts:
Mr Williamson demonstrated the incident using the head on and side on films. He pointed out to the committee that Mr Tanaka allowed his mount to come out and dictate SHUKA across the heels of CARRICK when not the required distance clear. He conceded that TILDA did hang out after the incident and raced awkwardly.
Mr Tanaka said he accepted the evidence put forward by Mr Williamson. He told the committee that his mount was lugging out as the leader had come back on him just prior to the incident. He advised the committee that he had been wasting to take a ride at 52kg and was struggling to hold TILDA, he conceded that SHUKA was squeezed up when he shifted ground.
Submissions for Penalty:
Mr George produced Mr Tanaka's record which showed 2 previous suspensions in the last 12 months. He submitted the degree of carelessness was in the low range and conceded that TILDA had played its part in the incident. Mr George confirmed it was a Group 2 race and stated Mr Tanaka had incurred a suspension on the 15th February 2012, with this due to commence after racing today the 18th of February.
Mr Tanaka submitted that he had 3 firm commitments on the 25th of February 2012, which does include a ride in the Group 2 Matamata Breeders. He acknowledged to the committee that he would seek a deferment to his second suspension. He submitted he has ridden in the South Island, however when questioned he admitted to the committee he had no intentions to ride at Omakau on the 2nd of March or Cromwell on the 4th of March 2012.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Tanaka's admission of the breach and his overall good record. However this has to be balanced against the aggravating fact the race was of Group 2 status. It must also be noted this was his second charge for careless riding in a week. We assess the level of carelessness in the low range.
Mr Tanaka's first suspension starts after racing on the 18th of February 2012 and concludes after racing on the 24th of February 2012. Therefore he is eligible to ride only at Matamata on the 25th of February 2012 prior to commencing his second suspension. The committee granted Mr Tanaka's submission to seek a deferment to his suspension as per rule 1106(2).
As Mr Tanaka admitted to the committee he has no intention of riding at Omakau on the 2nd of March or Cromwell on the 4th of March 2012 we therefore have not included these days in his suspension.
