This information pertains to race 8 at the Auckland Racing Club's meeting on 18.2.06. Mr Coles, the informant, has charged Mr V Colgan under Rule 520(4)(a) when he failed to fulfil the engagement to ride the horse KINGSINGA.

Mr Colgan admitted the breach of the rule.

Mr Colgan said in his submissions he only made a verbal commitment to ride KINGSINGA and did endeavour to tell Mr Collett, the trainer, as soon as he knew he would not be attending Ellerslie. He said it was before declaration time when he finally made contact with the trainer. Mr Colgan said Mr Collett was in Australia when he first tried to make contact.

Mr Coles said that what Mr Colgan had said was correct, but added that the race in question was a group two race which made Mr Colgan's transgression slightly more serious than normal. He added this was Mr Colgan's first breach of this rule.

PENALTY:

--

The Committee considered all submissions and took into account Mr Colgan's guilty plea. The fact that this was his first charge under this rule, and that it was before declaration time that he informed Mr Collett of his decision not to ride at Ellerslie. Our only concern was that he did break a verbal commitment to ride in a group two race. Accordingly we impose a fine of $250.
