In Race 1, Majestic Breakfast With The Stars 1200, Mr P Hillis filed an information alleging that PINSOIR or its rider, placed second by the judge, interfered with the chances of BEGGARS BANQUET placed third by the judge in the final straight. The connections of BEGGARS BANQUET were represented by trainer, Mr P Hillis and rider Miss Sara-Lee Kelly, and the filing fee was lodged.

The connections of PINSOIR were represented by trainer, Mr P Duncan, and rider Mr G Cooksley.

Stipendiary Steward, Mr A Coles, gave the margin of half a length between second and third and reserved the right to charge Mr Cooksley. Mr Hillis demonstrated the video and showed PINSOIR and BEGGARS BANQUET entering the straight. Soon after entering the straight PINSOIR who was showing a tendency to hang started an outward movement. The outward movement took the line of BEGGARS BANQUET when only one length clear causing a loss of 1 to 1-1/2 lengths to BEGGARS BANQUET. The outward movement continued over 5 horse widths. BEGGARS BANQUET lost momentum and took some time to recover and then ran on to finish within half a length of PINSOIR.

Mr Cooksley, rider of PINSOIR, claimed that BEGGARS BANQUET had time to run on and finish second but was not good enough.

Mr Duncan felt Miss Kelly did not have to stop riding at any stage.

--

Mr Coles said BEGGARS BANQUET had made up ground and we had to decide if the interference was more than half a length.

--

The Panel is satisfied that interference occurred by PINSOIR and affected the chances of BEGGARS BANQUET by causing a check of 1 to 1-1/2 lengths when PINSOIR was only one length clear. BEGGARS BANQUET recovered to be half a length at the finish running on.

--

The Panel exercised its discretion to relegate PINSOIR behind BEGGARS BANQUET. The protest of Mr P Hillis is upheld and the placings are now:
