Penalty:
The Committee granted Mr Asano a deferment to his suspension pursuant to Rule 1106(2). Accordingly, his licence to ride in races is suspended for a period of 5 days commencing after racing on 24 October 2020 and concluding after racing on 31 October 2020.
Facts:
This charge arises from the running of Race 5, the Auckland Co-Op Taxis 1600. Senior Stipendiary Steward Mr Williamson filed an Information pursuant to Rule 638(1)(d) alleging the rider of INCY WINCY SPIDER (K Asano), allowed his mount to shift out dictating FLUROBUS wider which was hampered passing the 800 metres.
Apprentice rider Mr Asano acknowledged he understood the Rule and confirmed his admission of the breach. He was assisted at the hearing by the Northern Rider Mentor, Mr N Harris.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using the back straight video footage Stipendiary Steward Mr Coles demonstrated the incident and identified the two horses and riders concerned; namely INCY WINCY SPIDER (K Asano) and FLUROBUS (C Burdan). He told the Committee that approaching the 800-metre mark INCY WINCY SPIDER was racing in a loose one-off position in third last place. He said that Mr Asano angled his mount outwards, continued to ride forward and in doing so dictated FLUROBUS wider on the track. Mr Coles estimated that when Mr Asano shifted out, he was barely ¾ length clear of FLUROBUS.
Mr Asano said that his horse was racing greenly and at the time the pace eased up front resulting in him having to take action to avoid the horse directly in front coming back onto him.
Mr Harris agreed with Mr Asano’s assessment. He added that his mount was a 3-start maiden who was racing out of its class. He also pointed out that Mr Asano had only ridden at Ellerslie once previously and the course can be very challenging to ride on for any inexperienced rider.
Submissions for Penalty:
Mr Williamson produced Mr Asano’s riding record which indicated 4 previous breaches under the careless riding Rule in the last 12 months. The most recent at the Ashburton meeting on 1 August 2020 and resulted in a 3-day suspension. Despite having breached the Rule on 4 previous occasions there was a 7-month gap between the 3rd and 4th charges; and 2 of the charges were on the same race day.
Mr Williamson said Stewards assessed the level of carelessness in the low range. He submitted that any proposed suspension should be commensurate with low range penalty.
Mr Williamson added that Mr Asano is a busy apprentice rider who had 492 race day rides last season.
Mr Asano advised that he has confirmed engagements during the next week and sought a 7 day deferment to any proposed suspension.
In terms of any proposed penalty Mr Asano asked the Committee to take into account the factors that he had identified earlier in the hearing including his mount's racing manners and the easing of the pace.
Reasons for Penalty:
After considering the submissions and reviewing the race film the Committee determined Mr Asano’s carelessness to be low range and adopted a 6-day starting point. This is in conformity with the Penalty Guide for Judicial Committees which recommends a 6 day starting point for low range carelessness.
The available films established that Mr Asano allowed his mount to shift out whilst riding forward when not the required distance clear of FLUROBUS. This caused that runner to be shifted out 3 horse-widths wider on the track.
There are no particular aggravating factors associated with the breach.
Mr Asano’s riding record was assessed as being fair, given that this is his 5th breach in 12 months, albeit the Committee acknowledges there was a 7-month gap between his 3rd and 4th breach, and 2 of the breaches were incurred on the same day. The Committee further noted that Mr Asano is a particularly busy apprentice rider whose services are in demand in both Islands. On that basis his record was treated as a neutral factor.
The only mitigating factor considered was Mr Asano’s admission of the breach for which we afforded him a 1-day reduction from the 6-day starting point.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 (national) days.
