In Race 10 a protest was lodged by Stipendiary Steward Mr J P Oatham under Rule 876 (1) alleging that EBONY STRANGE, trained by Mr T J Ryan and ridden by Mr G McKeon, placed first, interfered on two occasions in the final straight with RED BUNTING

DECISION REASON & PENALTY

--

In Race 10 a protest was lodged by Stipendiary Steward Mr J P Oatham under Rule 876 (1) alleging that EBONY STRANGE, trained by Mr T J Ryan and ridden by Mr G McKeon, placed first, interfered on two occasions in the final straight with RED BUNTING, trained by Mr R and Ms M Liefting and ridden by Mr M Sweeney, placed third. The margin between the second placed VERIFY and third was a neck.

Mr Oatham stated that RED BUNTING was checked by EBONY STRANGE 200 metres from the finish when it moved out and took the line and checked the forward motion of RED BUNTING causing the rider Mr M Sweeney to lose a length.

Assistant Stipendiary Steward Mr Robinson demonstrated this on the video head and side on films stating that under the whip there were two outward movements of EBONY STRANGE, the second at the 200 metre mark and in doing so took the line of RED BUNTING causing it to lose a length while checking off the heels of EBONY STRANGE and in doing so cost RED BUNTING the opportunity of finishing in a better position. At the time RED BUNTING was making ground on the second placed horse. Mr Sweeney confirmed that his changes were affected.

Mr McKeon claimed he only moved half a width and that the fact that the horses were close to the outside rail contributed to the incident. Mr Ryan considered that Mr Sweeney over-reacted to the outward movement of EBONY STRANGE and that his movement out was only minimal.

In his closing statement Mr Oatham said that Mr McKeon did take the line of RED BUNTING and affect its chances of a better placing.

The judicial panel decided that interference occurred by the outward movement of EBONY STRANGE and the check did affect the forward momentum of RED BUNTING who finished a neck behind VERIFY placed second. This affected RED BUNTING's chances of a better placing. The panel exercised its discretion to uphold the protest and relegate EBONY STRANGE to third.
