Following a protest and relegation Mr McKeon did not admit a breach of Rule 871 (1) (d) in that he permitted his mount EBONY STRANGE to shift outwards in the straight when not clear of HIJACK ridden by Miss N Collet, and then RED BUNTING ridden by Mr M Sweeney.

Stipendiary Steward Mr J Oatham stated that EBONY STRANGE moved outward from the 200 metres when not sufficiently clear firstly of HIJACK causing interference to this horse and then RED BUNTING.

Assistant Stipendiary Steward Mr Robinson demonstrated on the video the outward movement to interfere with both horses. Mr McKeon's mount under the whip was shown to move outwards and be straightened on 4 occasions and on the last occasion interfering with RED BUNTING resulting in a protest and relegation. Mr Robinson said that Mr McKeon had ample warning that use of the whip was affecting his mount's outward movement and that Mr McKeon continued to ride forward throughout.

Mr Oatham called Natasha Collett, rider of HIJACK, who confirmed tightening on two occasions caused by the outward movement of Mr McKeon's mount. This caused her to check her mount with contact being made on one occasion when Mr McKeon was not the required distance clear.

Mr Oatham called Mark Sweeney, rider of RED BUNTING, who confirmed tightening on two occasions and was not sufficiently clear on the second occasion causing him to check off the heels of Mr McKeon's mount when his mount RED BUNTING was running on.

Mr McKeon stated his horse was running greenly and he attempted to straighten every time but he was attempting to win the race.

The judicial panel found the charge proven in that although Mr McKeon took corrective measures more constraint should have been taken as checks were sustained by both HIJACK and EBONY STRANGE.

Mr Oatham made submissions on penalty in that Mr McKeon had been riding in New Zealand for 12 months and that this was his first breach of the rule and has a good record as he rides throughout New Zealand. However, as a relegation had occurred, a suspension was warranted.

Mr McKeon submitted that he had had a minor breach of this rule in the way of a fine early in his riding here. He also stated that he was to ride at the Brisbane carnival next Saturday.

The panel took these submissions into consideration and accepted that some corrective measures had been taken but not sufficient to prevent the interference to HIJACK and RED BUNTING with the resulting relegation of EBONY STRANGE. Also taken into account with respect to penalty was the good record of Mr McKeon.

Mr McKeon is suspended from the conclusion of racing on Wednesday 20th June until the conclusion of racing on Wednesday 27th June. This, for Mr McKeon, was effectively a 3 day suspension.
