Ms Thornton is suspended from riding  after racing on Saturday 22nd December until the end of racing on 31st December 2012 -effectively 5 days.

Charge:

Near the 400 metre mark Jockey T Thornton (Maximum Height) allowed her mount to shift out when insufficiently clear of  Pycok Flyer (T Harris) who was dictated out into the line of Have No Mercy (M DuPlessis) which was checked.

Facts:

Stipendiary Steward Mr Oatham lodged an information alleging careless riding by Jockey Ms T Thornton in race 8.
 
Ms Thornton admitted the breach and appeared for the hearing.
 
Stipendiary Steward Mr M Williamson referred the committee to video footage of race 8 and identified the relevant runners as they neared the 400 metre mark.  Ms Thornton on Maximum Height on the running rail had Pykok Flyer two widths outside with Have No Mercy outside that runner. Ms Thornton came out to obtain clear running and in doing so dictated Pycok Flyer outwards onto the line of Show no Mercy which became unbalanced and was checked.  At no stage was Ms Thornton clear enough of Pycok Flyer to shift out without causing interference.  The effect of the interference to Have No Mercy had been exaggerated because it had occurred on the bend.
 
Ms Thornton said she had angled out from the rail to avoid the heels of the horse in front which fishtailed her into the other runners.  The check had been over emphasised due to the bend.  She conceded she had moved out and caused interference.

Reasons for Decision:

It was clear to the committee that Ms Thornton had moved out when not sufficiently clear subsequently causing interference to the outside runners.  The resultant interference to those horses was exaggerated because the incident had occurred on the turn into the final straight.

Submissions for Penalty:

On Penalty Mr Oatham submitted that a penalty of 5 days suspension was appropriate.  The JCA guidlines indicated a starting point of 5 days but Ms Thornton had a good record with two previous charges in the last 12 months.  She had admitted the breach which he considered midrange.  However the aggravating factor was the severe check on Have No Mercy.
 
Ms Thornton had no further comments and  confirmed she had commitments up to  22nd December and requested any suspension to start after that date.  She confirmed she was a North Island rider.

Reasons for Penalty:

The committee took into account Ms Thornton's guilty plea and her good record in mitigation.  Aggravating features were the fact that although the level of carelessness was assessed as mid range the result impacted on two other horses with Have No Mercy effectively eliminated from a potentially dividend bearing place.
