Decision:
It was clear from the video footage that interference had taken place. Shortly after the start when pressing for the lead Ms Whiteside had dictated the line of two inside horses when not sufficiently clear, the resultant interference causing one jockey to take hold.
Penalty:
Ms Whiteside is suspended from riding after racing at Matamata on the 19th December. The suspension is for a period of 4 days and will conclude after racing on the 27th December 2012.
Charge:
Near the 1100 metre mark J Whiteside on Walsburgs Flight allowed her mount to shift in when not clear of Inara Belle (J Waddell) who was dictated into the line of St Moritz (C Grylls) who was checked.
Facts:
Stipendiary Steward Mr Oatham lodged an information alleging careless driving by Apprentice Jockey Ms J Whiteside during race 6.
Ms Whiteside appeared for the hearing and admitted the breach. She confirmed she did not want representation at the hearing having earlier taken advice from Mr Collet after he had viewed the films.
Mr Oatham referred the committee to the early stages of the race and identified the relevant runners. He showed Ms Whiteside moving forward with two runners on her inside. She moved down towards the running line when not sufficiently clear dictating the line of Inara Belle onto St Moritz forcing its jockey to take hold. Ms Whiteside had attempted to straighten and relieve the pressure but it was too late.
Ms Whiteside conceded she had moved across too quickly.

Mr Oatham told the committee the JCA guidelines indicated a starting point for careless riding at five days suspension. Ms Whiteside with approximately 300 rides over two years had never appeared for any breach. She had a very good record and he assessed the breach as being at the low end. Although St Moritz had suffered minor interference it had reacted poorly. He submitted that a suspension of 4 days was appropriate.
Ms Whiteside agreed with these submissions and confirmed she had rides for Matamata on the 19 December. She confirmed she rode only in the North Island.

The committee in arriving at an appropriate penalty took into account Ms Whiteside's admission of the breach, her excellent record, the low level of carelessness in mitigation. An aggravating feature was the interference suffered by two other runners.
