Code:

Meet Title:
Auckland RC - 16 December 2012
Meet Chair:
JHolloway
Meet Committee Member 1:
ADooley
Race Date:
2012/12/16
Race Number:
R5
Decision:
Charge established.
Penalty:
Mr Coleman is suspended from racing from the conclusion of racing on the 19th December 2012 until the conclusion of racing on the 27th December 2012, 4 racing days.
Charge:
Near the 1100 metre mark M Coleman on Travino allowed his mount to shift in when not sufficiently clear of Brokash ( R Norvall) which was checked.
Facts:
Stipendiary Steward Mr Oatham lodged an information alleging careless riding by Jockey M Coleman during the running of race 5.
Mr Coleman appeared for the hearing and confirmed his admission of the breach.
Mr Oatham referred the committee to video footage of the early stages of the race and identified the runners concerned. He showed near the 1100 metre mark Mr Coleman's mount move inwards when barely a length clear of Brokash which received a sharp check and Peridot who was also checked but not severely.
Mr Coleman admitted the films were pretty clear that he hadn't cleared the other horses.
Submissions for Decision:
Admitted charge established.
Reasons for Decision:
Admitted. It was clear that Mr Coleman had moved in when not clear of Brokash which received a sharp check.
Submissions for Penalty:
Mr Oatham said the Mr Coleman was a very experienced jockey with a very good record having only one previous breach on the 16th June 2012. On this occasion he had made an error of judgement but the level of carelessness was at the low end. In accordance with the JCA penalty guidelines the penalty starting point was five days suspension.
Mr Coleman had no comment on penalty but confirmed he was engaged to ride on Wednesday 19th December 2012 at Matamata and was not looking at South Island riding engagements.
Reasons for Penalty:
The committee assessed the breach as being at the lower end of the scale. Mr Coleman has a very good riding record and had admitted the breach. The only aggravating feature was the interference suffered. Balancing those factors a suspension of 4 riding days was considered appropriate.
