Decision:

The committee accordingly found the charge of careless riding proved.

Penalty:

We grant a deferment to Ms Thornton’s suspension as per rule 1106(2)

Accordingly we impose a suspension on Ms Thornton which will commence after racing on 18 February 2012 and to conclude after racing on 25 February 2012 (4 days).

Facts:

Following race 3 an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson alleged that near the 900 metres mark MONARCH (T Thornton) shifted in when not clear of GURU GIRL (J McDonald) which was checked.

Submissions for Decision:

Mr Williamson demonstrated the incident using the head on and side on films. He pointed out to the committee on the head on film that Ms Thornton was racing in a 3 wide position when she allows her mount to shift in and crowd GURU GIRL when only 1 length clear. This resulted in Mr McDonald having to take a hold of his mount and lose his rightful running line.

Mr McDonald informed Mr Williamson that he had received pressure from his outside when Ms Thornton shifted in when only 1 length clear. He said this resulted in his mount being crowded and checked from the incident.

Ms Thornton did not wish to cross examine Mr Williamson or Mr McDonald’s evidence. She declined the opportunity to call any witnesses.

Ms Thornton told the committee that her mount did shift in onto GURU GIRL, however believed that ALLANAH who was racing on the inside of the pair had contributed to the incident when it was getting its head up in the air.

Mr Williamson in summing up said that ALLANAH did not contribute to the incident. He believed that Ms Thornton simply shifted in and placed pressure on GURU GIRL when not the required distance clear.

Ms Thornton when given the opportunity to sum up had nothing further to say.

Reasons for Decision:

The committee carefully considered all the evidence presented. Having reviewed the video films, we firmly believe that Ms Thornton has erred in shifting ground from a 3 wide position to a 1 off position when only 1 length clear. We looked at Ms Thornton’s evidence that ALLANAH had contributed to the incident, however the video films did not support this.

Submissions for Penalty:

Mr Williamson produced Ms Thornton’s record which showed 1previous suspension in the last 12 months, which is a very good record. He submitted the level of carelessness was low range and submitted a suspension at the lower end would be appropriate.

Ms Thornton told the committee she had firm commitments up to and including 18th February 2012. She advised the committee that she rides only in the North Island.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Ms Thornton’s very good record. However, this has to be balanced against the level of carelessness which the committee assess to be low range. We acknowledge that Ms Thornton rides only in the North Island and she has firm commitments up to the 18th February 2012.
