As Mr Tanaka admitted the breach we find the charge proved.

Penalty:

We grant a deferment to Mr Tanaka's suspension as per rule 1106(2).

Accordingly we impose a suspension on Mr Tanaka which will commence after racing on 18 February 2012 and to conclude after racing on 24 February 2012 (4 days).

Facts:

Following race 3, an information was filed pursuant to Rule 638(1) (d).The informant Mr Williamson alleged that near the 1,000 metres mark ALLANAH (M Tanaka) shifted in when not clear of DIAMONDS IN TIME which was checked.

Submissions for Decision:

Mr Williamson demonstrated the incident using the head on and side on films. He pointed out to the committee that Mr Tanaka allows his mount to shift in and crowd DIAMONDS IN TIME when only 1 length clear. This resulted in DIAMONDS IN TIME being awkwardly placed against the running rail; he said Mr Tanaka did not give sufficient room to the runner on his inside.

Mr Tanaka told the committee that he did tighten the runner on his inside, he admitted to over reacting to GURU GIRL who was coming across on his outside. He said he thought there was enough room for the runner on his inside.

Submissions for Penalty:

Mr Williamson produced Mr Tanaka's record which showed nil previous suspensions in the last 12 months. He submitted the degree of carelessness was low to mid range and rated Mr Tanaka's riding record as very good. He said Mr Tanaka should be given credit for his early admission of the breach and believed a suspension at the low end would be appropriate.

Mr Tanaka when asked for his commitments in the next 7 days he was unsure. The committee encouraged Mr Tanaka to contact his agent to confirm his riding commitments. The hearing was adjourned for 5 minutes to allow this to happen. Upon his return Mr Tanaka advised the committee that he firm commitments up to and including 18th February 2012. Mr Tanaka said he has ridden in the South Island at least 6 times this season, Mr Williamson accepted this submission to be correct.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. The mitigating factors are Mr Tanaka's admission of the breach and his excellent riding record. However, this has to be balanced against the level of carelessness which the committee assess to be closer to mid range than low range. We accept that Mr Tanaka has travelled to the South Island on a number of occasions in this season.
