Following Race 5 the Informant requested a Ruling under Rule 912(1) as to whether UNIVERSAL CHARM ridden by L Tiley was denied a fair start.

BACKGROUND:
--Following Race 5 the Informant requested a Ruling under Rule 912(1) as to whether UNIVERSAL CHARM ridden by L Tiley was denied a fair start.
--Mr Treweek Assistant Stipendiary Steward demonstrated the video films which showed UNIVERSAL CHARM becoming unsettled in the gates just prior to the start which caused the horse to be slow away.
--The Starter Mr Harrison confirmed there was no mechanical failure of the starting stalls.
--DECISION AND REASONS:
--The Committee considered all evidence carefully and repeated viewing the video films.
--We are satisfied there was no evidence of mechanical failure and there was no calling from Jockey L Tiley.
--We find that the horse was on all four feet just prior to the gates opening and only became fractious split seconds before the gates opened.
--We find that the horse UNIVERSAL CHARM was slow away on its own accord. Accordingy we rule that the horse was not denied a fair start and we deem the horse to be a runner.
