As Ms Satherley admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted Ms Satherley a deferment to her suspension pursuant to Rule 1106(2). Accordingly, her Licence to ride in races is suspended for a period of 4 days commencing after racing on 21 March 2021 and concluding after racing on 27 March 2021. In addition, we impose a $500 fine.

Facts:

This charge arises from the running of Race 3, the Gravity 2100. Chief Stipendiary Steward, Mr Oatham filed an Information pursuant to Rule 638(1)(d) alleging the Rider of WHEAO (L Satherley) directed her mount out in when not clear of TIA D’OR which was crowded and checked near the 300 metres.

Ms Satherley acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using all available video footage (head, side and rear), Stipendiary Steward, Mr Coles demonstrated the incident and identified all horses and Riders concerned. He said that in the home straight, approaching the 300-metre mark, Ms Satherley was racing behind ISKANDER (E McCall), with TAI D’DOR (S Collett) on her the outer and in turn THE BUZZ (J FAWCETT) was racing on the outside of that horse.

Mr Coles said Ms Satherley attempted a run to the outside of ISKANDER and between TIA D’OR. He said that she once she had committed herself, it was clear that there was no run available for her. As a result TAI D’OR was checked and made contact with THE BUZZ.

In response Ms Satherley said that by time she committed herself to take the run to the outside of ISKANDER, it shifted out slightly and she had to continue to avoid racing onto its heels. She accepted there was only a half gap.

Submissions for Penalty:

Mr Oatham produced Ms Satherley’s riding record which indicated 1 previous breach under the careless riding Rule in the last 12 months. That breach occurred on 17 October 2020 and resulted in a 4-day suspension. He said her riding record is very good given that she had 341 rides in the last 12 months.

Mr Oatham said Stewards assessed the level of carelessness to be in the mid-range. He added that although the breach occurred on a Premier race day and the race had a Stake of $50,000 it was not a Group or Listed race.

Ms Satherley sought an 8 day deferment to any proposed suspension. In terms of any proposed penalty Ms Satherley asked that her good riding record be taken into account.

Reasons for Penalty:

After considering the submissions and reviewing the Race film, the Committee determined Ms Satherley’s carelessness to be in the mid-range and adopted a 5-day (suspension) and $500 (fine) as the starting point. This conforms with the revised NZTR Penalty Guide for mid-range carelessness.

The available films established that Ms Satherley committed herself to a run between ISKANDER and TIA D’OR when there was only ever a half gap available. Notwithstanding, she forced a run and contacted TIA D’OR who was checked. It was noted that at the time TIA D’OR was already racing in tight quarters on the inside of THE BUZZ.

There are no particular aggravating factors associated with the breach.

Ms Satherley admitted the breach at the first available opportunity and she has a very good riding record. For those combined factors we afforded her a 1-day reduction from the 5-day starting point.

After taking into account all the above factors the Committee considered that an appropriate suspension was 4 (national) days and a $500 fine.
