--Following Race 6 a protest was lodged pursuant to Rule 642 (1). The informant, Mr M Sweeney, rider of the 4th horse CHARMA, alleged that JIMMY CHOUX (J Riddell) placed 3rd by the Judge caused interference to his mount during the final 100 metres.
--All connections were informed of the protest.

--Following Race 6 a protest was lodged pursuant to Rule 642 (1). The informant, Mr M Sweeney, rider of the 4th horse CHARMA, alleged that JIMMY CHOUX (J Riddell) placed 3rd by the Judge caused interference to his mount during the final 100 metres.
--All connections were informed of the protest.

Mr Sweeney demonstrated the video films and pointed out to those present that, at a point soon after the 100 metres, JIMMY CHOUX shifted ground outwards and hampered his mount. He said he had to stop riding and it cost him 2 lengths. He said CHARMA was doing his best work at the time and he believed it cost him 3rd place.
--Messrs M & G Sanders confirmed Mr Sweeney’s evidence and had nothing further to add.
--Mr Riddell, rider of JIMMY CHOUX, said he was dictated outwards by BANCHEE and CELLARMASTER. He said the critical factor was the 1 ¼ margin at the post and his shift outwards was only for 5 or 6 strides. He added the incident occurred when the race was nearly over.
--Mr Barry, Trainer of JIMMY CHOUX, confirmed Mr Riddell’s evidence and believed that CHARMA had nothing left. In his opinion CHARMA was never going to make up the 1 ¼ length margin between the 2 horses.
--Mr C George when asked for his assessment of the incident said it was clear on the videos that JIMMY CHOUX did shift out which he believed cost Mr Sweeney ¼ of a length. However because of the 1 ¼ length margin at the post and the close proximity to the finish when the incident occurred he does not believe that CHARMA would have beaten JIMMY CHOUX in any event.
--Mr Sweeney had no further evidence to submit and the same applied to the defendant Mr Riddell.
--DECISION
--The Committee carefully considered all evidence and reviewed the video film. While we concede there was interference to CHARMA caused by JIMMY CHOUX shifting out we are not satisfied that CHARMA would have beaten JIMMY CHOUX if interference had not occurred. The key reasons for this decision are as follows:
--1 The margin between 3rd and 4th at the post was 1 ¼ lengths.
2 The shift outwards from JIMMY CHOUX occurred only 70 metres from the post.
3 The strong manner in which JIMMY CHOUX finished the race
4 After the interference JIMMY CHOUX was always holding a comfortable advantage over CHARMA.
Accordingly the protest is dismissed and the Judges placings shall stand.
