Following race 8, an information was filed pursuant to rule 638 (1) (D). The Informant, Stipendiary Steward Mr A Coles alleged, that Apprentice Jockey Mr A Ng permitted his mount THE CLOSER to shift outwards near the 250 metres when not sufficiently clear of SCARLET DIVA (C. Lammas) and then INDIAN SKY (M. Walker) which were both checked.

Following race 8, an information was filed pursuant to rule 638 (1) (D). The Informant, Stipendiary Steward Mr A Coles alleged, that Apprentice Jockey Mr A Ng permitted his mount THE CLOSER to shift outwards near the 250 metres when not sufficiently clear of SCARLET DIVA (C. Lammas) and then INDIAN SKY (M. Walker) which were both checked.
Mr A Ng admitted the breach and was represented by his employer Mr L. Noble.
--Mr Oatham demonstrated the video films which clearly showed Apprentice Jockey Mr A Ng riding THE CLOSER shifted out several horse widths when only ¾ lengths to 1 length clear. He said Mr Ng was continuing to ride forward when he shifted ground which resulted in checks to SCARLET DIVA and INDIAN SKY.
--Mr Noble said he admitted that Mr Ng mount did shift out when Mr Ng changed his hands over. He informed the Committee that he would be sitting down with his apprentice and reviewing videos for educational purposes.
--PENALTY SUBMISSIONS
--Mr Coles said that Mr Ng had no previous careless riding changes. He said the interference was quite serious and could be put down to Mr Ng inexperience. He submitted a 4 day suspension would be appropriate.
--Mr Noble said Mr Ng had firm commitments at Counties on December 16th. It was confirmed that Mr Ng rides only in the North Island.
--PENALTY
--The committee carefully considered the evidence and submissions presented. Mitigating factors taken into account were Mr Ng guilty plea and this was his first offence, however, in this case Mr Ng did check two other horses in the incident.
--Accordingly we impose a suspension from race riding to start after racing on the 16th December 2009 and to conclude after racing on the 26th December 2009 (4 days)
