Following race 5, an information was filed pursuant to rule 638 (1) (d). The Informant, Stipendiary Steward Mr A Coles, alleged that Apprentice Jockey Mr V Ho permitted his mount SAINT PAT to shift inwards near the 1000 metres when not sufficiently clear of VELVET PRINCESS (L. Innes) crowding BUGS LAPIN (J. McDonald) onto STRANGER DANGER (V. Colgan) who was checked.

Following race 5, an information was filed pursuant to rule 638 (1) (d). The Informant, Stipendiary Steward Mr A Coles, alleged that Apprentice Jockey Mr V Ho permitted his mount SAINT PAT to shift inwards near the 1000 metres when not sufficiently clear of VELVET PRINCESS (L. Innes) crowding BUGS LAPIN (J. McDonald) onto STRANGER DANGER (V. Colgan) who was checked.

Mr V. Ho admitted the breach and was represented by trainer Mr L. Noble.

Mr Oatham demonstrated the interference using head on and side on films. It clearly showed Mr Ho angle his mount SAINT PAT inwards from a five wide position causing crowding and dictate the rightful line three runners on his inner. Mr Oatham said Mr Ho continued to shift in when not the required distance clear and in doing so causing severe checks to BUGS LAPIN ridden by Mr McDonald and STRANGER DANGER who was ridden by Mr V Colgan.

Mr Noble said it was an error of judgment by Mr Ho and conceded it got tight.

PENALTY SUBMISSIONS

--

Mr Coles said that two horses received quite severe checks from the inward movement of Mr Ho. He said Mr Ho did not have a good record having received six careless riding charges in the last eight months. He submitted a suspension in the 6-8 day range would be appropriate.

Mr Ho said he had firm commitments at Otaki on December 17th 2009.

Mr Oatham confirmed that Mr Ho does not travel to the South Island for rides but his employer Mr Scott had indicated, Mr Ho had planned to attend Riccarton on December 18th for two apprentice riders’ events.

PENALTY

--

The committee carefully considered the evidence and submissions presented. We viewed the seriousness of the breach as being at the high end, in which two runners received quite severe interference. We viewed Mr Ho’s six careless riding charges in the past 8 months to be a very poor record. We granted Mr Ho’s request that the suspension starts after racing at Otaki on Thursday and did take into account the Riccarton race meeting.

Accordingly we impose a suspension from race riding to start after racing on the 17th December 2009 and to conclude after racing on the 31st December 2009 (8 days)
