--Following race 2, an information was filed pursuant to rule 638 (1) (d). The Informant, Stipendiary Steward Mr A Coles alleged that rider Mr M Walker permitted his mount ‘NOT TONITE’ to shift inwards near the 1300 metres when not sufficiently clear of CAPE FEAR (S. SPRATT) who was checked.

--Following race 2, an information was filed pursuant to rule 638 (1) (d). The Informant, Stipendiary Steward Mr A Coles alleged that rider Mr M Walker permitted his mount ‘NOT TONITE’ to shift inwards near the 1300 metres when not sufficiently clear of CAPE FEAR (S. SPRATT) who was checked.
--Mr. M Walker admitted the breach.
--Stipendiary Steward Mr J McLaughlin demonstrated the video films which clearly showed, 100 metres after the start, Mr Walker riding NOT TONITE moved in from a 3 wide position and in doing so take the rightful line of CAPE FEAR (S. SPRATT). Mr Walker was only ¾ lengths clear when he shifted in.
--Mr Walker said that prior to the incident Miss Spratt’s mount was pulling and racing with its head up. He believed the interference was minimal.
--PENALTY SUBMISSIONS
--Mr. Coles said Mr Walker had four previous suspensions in the last 12 months. He said the offending was the lower end and believed a four day suspension would be appropriate.
--Mr Walker said he would like the suspensions to start immediately.

The committee carefully considered the evidence and submissions presented. We took into account the guilty plea; Mr Walker’s good riding record and the level of carelessness being at the low end.
Accordingly we impose a suspension from race riding to start after racing on the 13th December 2009 and to conclude after racing on the 19th December 2009 (4 days).
