DECISION AND REASON:

--

Following Race 3 an Information 7854 was filed pursuant to Rule 871(1)(d), by Stipendiary Steward Mr AR Coles, alleging a breach of the rule by Mr T Russell, rider of EYE ME UP, that of careless riding in that he angled his mount outwards when not sufficiently clear of COUNTRY GIRL (Mr LG Innes) who had to be sharply checked and forced on to ITS ONLY TALK (Mr MT Coleman) who suffered interference.

Mr Russell did not admit the breach.

Mr Coles asked Mr Innes if he was checked by the outward movement by Mr Russell, and he agreed that he was.

Mr Oatham, Stipendiary Steward, demonstrated with four films that there was only half a gap between SANTINO (Mr GL Cooksley) on the inside and COUNTRY GIRL (Mr LG Innes) and the outward angle of EYE ME UP's head with the resulting contact with COUNTRY GIRL and interference to ITS ONLY TALK. Mr Oatham said the outward movement was made worse by Mr Russell's mount but there was not a full gap to start with.

Mr Russell used the films in his evidence and admitted the gap was marginal and that his mount over reacted.

The judicial panel found the charge proven in that Mr Russell attempted to take a gap that he was not entitled to and in doing so checked Mr Innes on COUNTRY GIRL that resulted in interference to Mr Coleman on ITS ONLY TALK.

Taking into account the good riding record and the over reaction of EYE ME UP, the judicial committee suspended Mr Russell from the conclusion of racing on Sunday 16 December 2006 until the conclusion of racing on Saturday 23 December 2006, that being a three day suspension.
