As the breach was admitted we find the charge proved.
Penalty:
The committee has adopted 5 riding days as the starting point in considering an appropriate penalty. Without the mitigating factors we would assess the correct penalty would be one of 7 days. However, because of the mitigating factors already described we reduce this to one of 6 days. Accordingly we suspend Miss Myers from riding in races which is to commence after racing on 16 April and conclude after racing on 25 April 2013 (6 days).
Charge:
Following Race 7, The Manco Easter Handicap, the informant alleged that, near the 100 metres, Miss R Myers allowed her mount TYNE COT to shift out when not clear of MAXIMUM HEIGHT who was checked. This resulted in MAXIMUM HEIGHT being forced out onto INNOVATION who was checked and lost ground.
Rule 638 (1) (d) reads as follows: A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Facts:
Mr Williamson demonstrated the video films which showed TYNE COT racing in a midfield position near the 100 metres. At this point Miss Myers elected to come out to gain clear running but in doing so moved into the line of MAXIMUM HEIGHT. Mr Williamson submitted that Miss Myers was only 3/4 length clear when moving out resulting in MAXIMUM HEIGHT being forced into the line of INNOVATION which was checked.
Miss Myers admitted she did come out but said her horse was big and green. She added that as this was a Group 1 race she had to take every opportunity to improve and this was the reason she chose to move out.
Submissions for Penalty:
Mr Oatham told the committee Miss Myers had a very good record with one suspension in the last 12 months. He said another mitigating factor was that she had admitted the breach. However, this was a Group 1 race worth $200,000 and all connections deserve an interference free run. He submitted she was not entitled to shift out and he assessed the breach in the mid to high range. He concluded by saying an appropriate penalty would be 6 to 8 days.
Miss Myers said she had commitments up to and including 16 April and she rode throughout the whole country.
In answer to a question from the committee regarding her intentions to ride at Dunedin on 18 April and Wyndham on 22 April she informed us she had ridden at Dunedin this year but conceded she had never ridden at Wyndham.
Mr Oatham acknowledged that Miss Myers had ridden at Dunedin this year.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. Mitigating factors are, Miss Myers' admission of the breach and her very good record. However, in aggravation this breach occurred in a Group 1 race worth $200,000 and 2 horses received interference because Miss Myers was only 3/4 length clear when moving out.
The committee independently assesses this breach to be in the mid range.
In regard to Miss Myers' submissions we have taken the Dunedin meeting on 18 April into account because Miss Myers has ridden there this year. Conversely we have not taken into account the Wyndham meeting on 22 April as Miss Myers conceded she had never ridden there.
